Mounds View City Council June 26, 1989 <br />Regular Meeting Page Eleven <br />-------------------------------------------------------------------------- <br />Mr.Buckingham stated he feels there are property <br />rights of the people in the area to consider, for <br />the quiet enjoyment of their property. <br />Attorney Karney explained that in order to have a <br />property right in something, there must be an <br />ownership interest. The residents do not have <br />ownership of the road, and there will not be any <br />residential property taken, and there is already <br />a road there. <br />Attorney Karney also advised that in terms of legal <br />notice, the Council has met all responsibilities <br />for legal notice, and gone beyond that. There is <br />no requirement for notice until a road is actually <br />planned to be built. <br />P~layor Hankner stated the Comp Plan went through all kinds of <br />public hearings in 1980, and notice was given then. It was up to <br />the residents to liik into it to see how it inv°olved them. She <br />also made reference to a 2 page memo listing the dates <br />the Council discussed the project. The demographics.-of tl~ie <br />,__ <br />City are changing, with turnover occurring more every five <br />years. She added this Council has done everything they can <br />think of to inform the residents of what is happening,-and notice <br />has been given 't hat the Comp Plan is being updated, and it is <br />the responsibility of the residents to look into and see <br />how it effects them. <br />Mr. Buckingham asked if trucks could be restricted <br />if Woodale was not an MSA street. <br />Clerk/Administrator Pauley stated he believed so, <br />but would have to check with Mr. Minetor. He added <br />the road would be built to 9 ton, as they do with <br />all roads now, as they last much longer. He also <br />pointed out a notice had been put in the City <br />newsletter, in the Council Corner, which reports <br />on upcoming issues, and this item was mentioned <br />specifically. <br />Public Works Director Minetor joined the meeting <br />at 9:24 PM. <br />Ms. Lexxon stated she would Iike the street to <br />remain the way it was when she moved in, and that <br />any extension or improvement would devalue her <br />property. <br />Bill Ross, 5200 Greenfield, asked if the proper <br />boulevard would be restored if the street does <br />go through. <br />
