<br />. <br /> <br />. <br /> <br />. <br />. <br /> <br />Resolution 699 (V.l) <br />Page 2 <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission <br />makes the following findings regarding the possible adverse effects of this rezoning as required <br />by the Mounds View Zoning Code: <br /> <br />I. The Current zoning of the lots is R-1, Single Family Residential. The requested zoning <br />of the lots is R-3, Medium Density Residential. <br /> <br />2. According to the Comprehensive Plan, the parcels proposed to be rezoned are designated <br />either Single Family Attached or Single Family Detached. Only those lots within the <br />Single Family Attached area would be consistent with the Comprehensive Plan, as shown <br />on the Future Land Use Map. 34 of the requested 66 lots are within the Single Family <br />Detached area and would not be consistent with the Comprehensive Plan. The remaining <br />32 lots proposed to be rezoned would not be inconsistent with the Comprehensive Plan, <br />however the requested R-3 designation is the more intensive than what could be allowed <br />within an R-2 designation, which is also consistent with the Single Family Attached <br />future land use designation. <br /> <br />3. Many of the lots proposed to be rezoned are within the City's Wetland Zoning District. <br />15 of the lots are within the wetland while another 23 lots are within the buffer area. <br />Altogether, 38 lots have moderate to severe limitations due to the soils and wetlands. The <br />remaining lots may have grading and drainage issues which could further aggravate <br />stormwater management on the site. <br /> <br />4. The intensity of the potential development in 6 or 8-unit buildings would have a <br />significant impact to the existing residences and to the natural environment. The amount <br />of traffic generated by 34 townhome units added to the residential streets of Clearview <br />and Louisa Avenues would be extensive and could represent a safety hazard to the public, <br />depreciating the peace, health, safety and welfare of the neighborhood. <br /> <br />5. A high-density residential apartment complex is located on the north side of County Road <br />H2. On the south side of County Road H2 are the existing 6 townhome units and single- <br />family residential dwellings. The interior of the neighborhood, the area in which 34 <br />townhome units would take access, is developed exclusively as single-family residential. <br />To the east of the development area is a drainage ditch and wetland area. <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above findings <br />of fact, the infonnation and documents regarding the rezoning proposal, the report drafted by <br />staff and the testimony of the applicant, and in consideration of the public testimony given at the <br />public hearing, the Planning Commission does hereby recommend to the City Council denial of <br />the rezoning requests made by Martin Harstad. <br /> <br />BE IT FINALL Y RESOLVED that the Planning Commission directs staff to forward <br />this resolution to the City Council prior to approval of the minutes. <br />
