<br />. <br /> <br />. <br /> <br />. <br /> <br />Ref;olution 707-02 <br />August 21, 2002 <br />Page 2 <br /> <br />WHEREAS, before development may procecd, the Planning Commission and City <br />Council is rcquired to rcview and approve all applications for development; and, <br /> <br />WHEREAS, the City Code indicates that rezoning requests shall bc consistcnt with the <br />Future Land Use Map of the Comprehensive Plan and that the Planning Commission shall find <br />that the rezoning would not be detrimental to the neighborhood or adversely affect any adjoining <br />properties. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission <br />hcreby makes the following findings of fact related to this request: <br /> <br />1. The Future Land Use Map of the Comprehensive Plan designatcs this area as a Mixed <br />Use Planned Unit Development. The proposed Highway Business zoning district would <br />not be inconsistent with the vision for this area. <br /> <br />2. The rezoning of the property would not adversely affect any adjacent or nearby properties. <br />The PUD designation would have allowed an I 1,000 square foot office building in <br />addition to parking. The current proposal contemplates only parking. <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View Planning <br />Commission, based upon its review of the documentation and findings of fact, recommends <br />approval of the rezoning request from PUD to B-3. <br /> <br />NOW, THEREFORE, BE IT FIN ALL Y RESOLVED, the Mounds Vicw PlaIming <br />Commission, finding that the submitted site plan satisfies City Code, recommends approval of a <br />development review subject to the following conditions: <br /> <br />1. The Site Plan shall be revised as follows: <br /> <br />a. One additional handicap accessible space shall be identified with one being <br />marked "Van Accessible" unless the accessible spaces satisfy Universal Parking <br />Space Design guidelines. <br /> <br />b. The garbage dumpster constmction details shall be added to the site plan, <br /> <br />c. The crushed landscape rock shall be replaced with wood mulch or chips. <br /> <br />d. The dimension for the curb cut width shall bc indicated and shall not exceed 30 <br />feet. <br /> <br />e. A notation that indicates continuous B-612 perimeter curb around the parking lot <br />shall be added. <br /> <br />f. A notation shall be added that indicates the existing fence to be relocated or <br />replaced with a fence to match the existing privacy fenccs in the development. <br /> <br />g. A notation shall be added that the decorative wrought iron fence shall not exceed <br />4 feet in height. <br /> <br />2. The lighting plan shall be rcvised to show fixture details and pole height from grade. <br />
