<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution 710-02 <br />October 2, 2002 <br />Page 2 <br /> <br />WHEREAS, the Mounds View Planning Commission finds that the proposed auto repair <br />facility would not be out of place given the character and geography of the surrounding area; and, <br /> <br />WHEREAS, the Mounds View Planning Commission finds that the proposed auto repair <br />facility would not depreciate the neighborhood; and, <br /> <br />WHEREAS, the Mounds View Planning Commission granted a variance from the minimum <br />lot area requirement on September 18, 2002; and, <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission <br />recommends approval of the conditional use permit with the following stipulations: <br /> <br />1. The applicant shall arrange to record the City Council resolution approving the conditional <br />use permit with Ramsey County and provide proof of such recordation to the City within <br />sixty days of Council approval or this pertuit shall be considered null and void. <br /> <br />2. The entire site, other than that taken up by a building, structure or plantings, shall be surfaced with a <br />material to control dust, drainage and erosion, which is subject to the approval of the Director of <br />Public Works/City Engineer. <br /> <br />.., <br />.), <br /> <br />The lighting shall be accomplished in such a way as to have no direct source of light visible from <br />adjacent land in residential use or from the public right of way and shall be in compliance with <br />Section 1103.09 of this Title. <br /> <br />4. All signing and informational or visual communication devices shall be minimized and shall be in <br />compliance with the Mounds View Sign Code. <br /> <br />5. Provisions are made to control and reduce noise. <br /> <br />6. No outside storage except as allowed in compliance with subdivision 4 of Section 1114,04 shall <br />exist. <br /> <br />7. No outside sale or service except as allowed in compliance with subdivision 5 of Section 1114.04 <br />shall exist. <br /> <br />8. The auto repair facility shall only operate between the hours of7:00 am and 7:00 pm. The car wash <br />may operate 24 hours per day. <br /> <br />9. All conditions pertaining to a specific site are subject to change when the City Council, upon <br />investigation in relation to a formal request, finds that the general welfare and public betterment can <br />be served as well or better by modifYing the conditions. <br /> <br />10. <br /> <br />The parking requirement provided in Section 1121. 13 shall be met. <br />
