Mounds View City Council October 9, 1989 <br />Regular Meeting Page Four <br />-------------------------------------------------------------------------- <br />has been very difficult in the past to get that <br />approval. They would have final say on the road <br />going through, and they would be a major obstacle. <br />Mayor Hankner closed the public hearing and reopened <br />the regular meeting at 7:37 PM. <br />Mayor Hankner closed the regular meeting and opened <br />the next public hearing at 7:37 PM. <br />Ms. Hren explained Paster Enterprises has requested <br />rezoning of a portion of their property at Mounds <br />View Square from B-4 to B-3, to allow for a con- <br />venience food restaurant, which is a conditional use <br />in a B-3 district. The applicant has applied for a <br />CUP for a convenience food restaurant and drive- <br />through. They have also requested a PUD for the <br />entire Mounds View Square shopping center. <br />If the Council chooses not to rezone the property, <br />the other items could not go forward, so the rezoning <br />must be addressed first. It is important that the <br />surrounding zoning and uses of the property be taken <br />into consideration in a rezoning. Paster Enterprises <br />is proposing that only the pad of the building be <br />rezoned, not the entire parcel. The Council must <br />also consider other uses that could go into that <br />location, should the restaurant leave at some time <br />in the future.. <br />The Planning Commission has reviewed the request and <br />recommends approval to the Council of the rezoning <br />from B-4 to B-3. <br />Ms. Hren reviewed the requirements of a CUP and PUD. <br />The applicant will be able to meet the zoning <br />requirements with the exception of 34 parking spaces, <br />however, the PUD would waive that. 503 spaces in <br />total would be provided at the shopping center. The <br />site does need work, specifically with asthetics, and <br />this is the opportunity for the City to speak up and <br />address that. <br />Landscaping has been an issue which has been discussed <br />many times. Both the Planning Commission and Council <br />have said they would like the landscaping enhanced. <br />A section has been added to the development agreement <br />stipulating that whatever is put in must be maintained <br />and replaced as necessary. <br />9. Public Hearing: <br />Request of <br />Paster Enter- <br />prises for a <br />Partial Rezoning <br />from B-4 to <br />B-3, a Condi- <br />tional Use <br />Permit and <br />Planned Unit <br />Development <br />The Planning Commission also recommends to the <br />Council conceptual stage approval of both the CUP and <br />PUD. <br />
