Pa"ge 2 <br /> <br />WHEREAS, the Mounds View Planning Commission makes the following <br />findings of fact related to this request: <br /> <br />1. The Station, located at 2280 County Road I, property zoned B-2, <br />Limited Business, is a considered legal, non-conforming use. <br /> <br />2. Motor fuel stations are not permitted in the B-2, Limited Business <br />District <br /> <br />3. According to the Comprehensive Plan, Motor fuel stations are not <br />appropriate in areas designated "Neighborhood Commercial" <br /> <br />4. The Station does not comply with the minimum lot area-22,500 <br />square feet --for a motor fuel station, The Station's area is only 9,583 <br />square feet. <br /> <br />5. The Station does not comply with the minimum lot dimensions-150 x <br />130--for a motor fuel station. The station's dimensions are only 134 x <br />71. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning <br />Commission, based upon the above findings of fact, recommends denial of the <br />conditional use permit requested for The Station, located at 2280 County Road I. <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View Planning <br />Commission recognizes the right of "the Station" to continue operating at its present <br />location at 2280 County Road I as a legal non-conforming use. <br /> <br />BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs <br />staff to forward this resolution to the City Council prior to approval of the minutes. <br /> <br />Adopted this 3" day of November, 2004. n ~,.., < <br /> <br />f / :;;?;~1 Y' --C:~'c.....'
