Mounds View City Council Regular Meeting August 13, 1990 ------------------ ---- Page Four Mayor Hankner read a prepared statement, extending 9. Residen sympathy to Police Chief Tim Ramacher and his family Request on the recent death of both parents, as well as to Comments the family of Wally Skiba, a former employee who the Floo passed away recently. She also extended sympathy to Don Brager and Ric Minetor who each have a seriously ill parent. Mayor Hankner noted Mounds View has been declared Capital for a Day on August 22 and Staff is working with the Council in planning and organizing for that day. Mayor Hankner continued her prepared statement, con- cerning the resignation on July 20 of Donald Pauley, farmer Clerk/Administrator. She reviewed the form of government Mounds. View has under the Charter, and the fact the money paid to Mr. Pauley was called for in a contract written by him and execut eel by then Mayor McCarty. Legal opinion was given that with no termination date nor renegotiation date, the present Council was bound by the terms of the contract. Mayor Hankner stated it is time for the City to move forward. A meeting has been set for August 15th at 2 PM between the Council and management consultants, with Staff invited, to discuss what qualifications are desired in a new clerk/administrator. She recommended that Charlynn Robertson, a Mounds View resident and member of the Police Civil Service Commission and professional personnel manager assist in the process. Ms. Robertson has indicated her willingness to volunteer her time and expertise. Mr. McCarty stated he felt he had been singled out by Mayor Hankner;. with political motivation. He read a prepared list of questions concerning the resignation of Donald Pauley, the necessity of it,. cost to the City, urgency in doing it, and questioned whether the vote was split 3/2. He reminded the Council of the process followed in the termination of a former Clerk/Administrator, Jeff Nelson, who received two weeks severance pay versus Mr. Pauley's $42, 000. Mayor Hankner clarified the Council was bound by the contract, which had no termination date, and the vote by the Council was unanimous, 5/0. Attorney Meyers explained he had worked with Mr. Pauley for-10 years and knew him socially and as a friend, which he felt was a conflict of interest, which is why special counsel was recommended. He added the Council worked under the existing open meeting laws and data privacy laws, noting closed meetings are legitimate on personnel matters. t s• s and from r ,~ v
