� _ ._ :�__ .. :___ . ��� i <br />Longview Estates PC Report <br />November 5, 2003 <br />Page 3 <br />Recommendation: <br />Hold the public hearing (it remains open from the previous meeting) and further discuss the <br />proposed subdivision. Staff is seeking direction from the Commission regarding the <br />preliminary plat and whether it should be approved, modified or denied. <br />As was stated above, the preliminary plat satisfies the zoning and subdivision requirements, <br />even the expanded requirements for subdivisions within a wetlan� zoning district. It may <br />NOT however satisfy the minimum alteration requirement for wetland alterations. Staff <br />recommends that whatever action is taken by the Planning Commission, the applicant will <br />need to submit an application for a wetland alteration permit for Council consideration along <br />with the preliminary plat. <br />While it may be difficult to justify a recommendation of preliminary plat denial, the Planning <br />Commission may recommend preliminary plat approval subject to certain reasonable <br />modifications, such as less lots or larger lots. In addition to modification, the plat can be <br />approved subject to conditions, such as wetland alteration permit approval, Rice Creek <br />Watershed District approval, Ramsey County approval, park dedication fee payment, soil <br />suitability analysis, execution of a development agreement, and other stipulations relative to <br />the subdivision. <br />If the Planning Commission feels strongly that the preliminary plat should not be approved <br />because the plan is too intense for the area or for some other reasonable basis, an <br />appropriate finding of fact will need to be created and entered into the record to support the <br />position. Staff will consult with the City Attorney to assess the defensibility of such an action. <br />Finally, after all discussion and deliberation has concluded, staff recommends the Planning <br />Commission close the public hearing. (A new public hearing will be conducted by the City <br />Council.) <br />These are the options for the Commission to consider. Please direct staff accordingly. <br />1. Recommend approval of the preliminary plat, as presented. <br />2. Recommend approval of the preliminary plat, as modified or with conditions. <br />3.
