<br />RESOLUTION 1082-18 <br /> <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />A RESOLUTION RECOMMENDING APPROVAL OF ORDINANCE 940, AMENDING <br />THE CITY CODE, TITLE 1100, SECTION 1124 REGULATING WIRELESS <br />TELECOMMUNCIATION FACILITIES <br /> <br />WHEREAS, MN Statutes §237 (Telephone, Telegraph, Telecommunications) and §238 <br />(Cable Communications) were amended, effective May 31, 2017, allowing Small Cell Wireless <br />Facilities as a permitted use within right-of-way, with exceptions; and, <br /> <br />WHEREAS, the amended MN Statutes requires amendments to the Mounds View <br />Municipal Code, Title 900 (Public Ways and Property), and Title 1100 (Zoning Code); and, <br /> <br />WHEREAS, the City of Mounds View Municipal Code, Title 1100, Section 1124 <br />regulates Wireless Telecommunication Facilities; and, <br /> <br />WHEREAS, the Planning and Zoning Commission has considered the proposed <br />amendment, where applicable to the Zoning Code; and, <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the Planning and Zoning Commission <br />recommends that the City Council amend the Municipal Code, Section 1124 as follows; <br /> <br />TITLE 1100 <br /> <br />ZONING CODE <br /> <br /> <br />1124.02: DEFINITIONS: The following words and terms, for purposes of this <br />Chapter, shall be defined as follows: <br /> <br />Subd 6. SMALL WIRELESS FACILITY means a wireless facility that meets both of <br />the following qualifications: <br />(1) each antenna is located inside an enclosure of no more than six cubic feet in <br />volume or could fit within such an enclosure; and <br />(2) all other wireless equipment associated with the small wireless facility provided <br />such equipment is, in aggregate, no more than 28 cubic feet in volume, not <br />including electric meters, concealment elements, telecommunications demarcation <br />boxes, battery backup power systems, grounding equipment, power transfer <br />switches, cutoff switches, cable, conduit, vertical cable runs for the connection of <br />power and other services, and any equipment concealed from public view within <br />or behind an existing structure or concealment.
