Item No. 10C-3 <br />Type of Business: CB <br />WK: Work Session; PH: Public Hearing; <br />CA: Consent Agenda; CB: Council Business City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Givonna Reed, Assistant to the City Administrator <br />Item Title/Subject: Golf Course Personnel <br />Date of Report: March 26, 2001 <br /> <br />Background <br /> <br />As was reported at the February 26, 2001 HR Committee meeting and in my March 9, <br />2001 memo to the City Council, we currently have a situation where a seasonal Golf <br />Course employee may legally be considered a regular City employee. <br /> <br />In late January of this year the Golf Course Manager asked the City Attorney, City <br />Administrator, I to consider bringing back the individual in question or pay unemployment <br />until he returned as a seasonal Golf Course employee for the 2001 season. After some <br />discussion it was determined that legally this individual may be considered a regular <br />employee based on a number of factors including the following: the individual was <br />reappointed to the same position for a number of years without having to reapply; the <br />individual has stayed on for approximately 9 months each year; the individual was never <br />“terminated” from the payroll system; and the individual was never notified in writing at <br />the beginning of the employment relationship of the exact start and end dates for his <br />term of employment. <br /> <br />Discussion <br /> <br />Establishing and following the approved procedures and parameters for hiring seasonal <br />employees ensures that in the future the City will not be in this position. The City <br />Attorney has met with the City Administrator, Public Works Director, Golf Course <br />Manager and myself to explain the procedures that should be followed in the future <br />when hiring seasonal employees. Those procedures are described in Resolution 5546 <br />(Adopting Procedures for Hiring Seasonal Employees). The next step is for the Council <br />to classify the individual in question. <br /> <br />I have inquired of the Golf Course Manager regarding whether this individual could be <br />hired for the Assistant Superintendent position that is currently vacant. I was advised <br />that the Assistant Superintendent position is a groundskeeper position and the individual <br />in question serves the Golf Course as an Assistant Professional and Clubhouse Clerk. <br />The Golf Course Manager has indicated that the skills required for these two positions <br />are very different. <br /> <br />The City received 30% of the fees this individual generated from giving golf lessons <br />totaling $2885 in 2000 and $1807 in 1999. These revenues go to support Golf Course <br />operations. In 2000 and 1999 the City paid wages totaling $31,445 and $24,121
