The Alcohol and Gambling Enforcement Division has advised that it is possible <br />for Mr. Waste to terminate his lease agreement with the Lions. The City and <br />County would need to receive written notice of termination from Mr. Waste. <br /> <br />Mr. Waste has advised me that since the July 9th Council meeting he has <br />changed his mind about terminating the lease with the Lions. The Lions have <br />agreed to make some changes and, consequently, will continue to offer <br />charitable gambling at Robert’s Off 20. Per the City Attorney’s recommendation I <br />have asked Mr. Waste to submit a letter to the City indicating that he wishes to <br />continue his partnership with the Lions. <br /> <br />Staff was not aware of the existence of the Lions’ charitable gambling license <br />(expires Jan. 31, 2001) because the application materials and license certificate <br />are not on file with the City. There are, however, official minutes and an <br />approved resolution indicating that the Lions’ application was approved by the <br />City Council in November 1999. <br /> <br />Recommendation <br /> <br />The City Attorney has advised that upon receipt of the letter from Mr. Waste <br />indicating that he intends to continue his relationship with the Lions rather than <br />lease space to Lake Region Hockey the Council should “deny” the application <br />from Lake Region Hockey based on the lack of valid application. <br /> <br />At this time staff has not received the letter from Mr. Waste.
