Resolution No. 5462 <br />August 14, 2000 <br />Page 3 <br />WHEREAS, the City Council finds that this proposal meets the special requirements and <br />standards for commercial PUDs regarding minimum project size, minimum street frontage and <br />minimum property width and landscaping; and, <br /> <br />WHEREAS, the PUD stipulations and guidelines which among other things specify the <br />maximum densities, minimum setbacks and maximum building heights to be allowed, and <br />special criteria applicable to the development of this PUD are attached as Exhibit 2 to this <br />Resolution; and, <br /> <br />WHEREAS, the conditions and requirements regarding the proposed exchange of real <br />property between the City and TOLD are fully addressed in the Contract for Private <br />Development, attached as Exhibit 3 to this Resolution; and, together with the PUD Document, <br />shall be considered the governing document for this development; and, <br /> <br />WHEREAS, the Mounds View City Council has received a recommendation of approval <br />from the Mounds View Planning Commission as stated in Planning Commission Resolution No. <br />623-00. <br /> <br />NOW, THEREFORE BE IT RESOLVED, having held a public hearing for the <br />proposed Walgreens PUD and requested exchange of land between the City and TOLD, the <br />Mounds View City Council approves the Planned Unit Development and exchange of land <br />subject to the conditions, terms and stipulations as stated in the PUD Document (Exhibit 2) and <br />the Contract for Private Development (Exhibit 3) and authorizes staff to draft ordinances to <br />effectuate the rezoning of the subject properties and exchange of land <br /> <br />Adopted this 14th day of August, 2000. <br /> <br /> <br /> <br />______________________________ <br />Dan Coughlin, Mayor <br /> <br />ATTEST: <br /> <br />______________________________ <br />Michael Ulrich, Interim City Administrator <br /> <br />(SEAL) <br /> <br /> <br /> <br /> <br /> <br />S:\DATA\GROUPS\COMDEV\DEVCASES\WALGREENS (MA00-001, ZC00-002, DE00-002)\RESOLUTION 5462- PUD APPROVAL.DOC
