Waste Report <br />2251 Oakwood Drive <br />May 22, 2000 <br />Page 3 <br /> <br />5. The use is consistent with the purposes of the Zoning Code and the purposes of the zoning <br />district in which the applicant intends to locate the proposed use. <br /> <br />The City Code conditionally allows for garages larger than 952 square feet as long as certain <br />requirements and criteria are met. This proposal satisfies all dimensional and zoning <br />requirements. <br /> <br />6. The use is not in conflict with the Comprehensive Plan of the City. <br /> <br />The City Council finds the proposed use is consistent with the Comprehensive Plan in that the <br />Comprehensive Plan encourages the development and physical improvement or residential <br />lots as one means of protecting and expanding property values. <br /> <br />7. The use will not cause traffic hazards or congestion. <br /> <br /> The proposed garage would not cause and traffic hazards or congestion. <br /> <br />8. Adequate utilities, access roads, drainage and necessary facilities have been or will be <br />provided. <br /> <br />The proposed garage will not necessitate any utilities above and beyond what is already <br />provided to the site. <br /> <br />Planning Commission Action: <br /> <br />On May 17, 2000, the Planning Commission held a public hearing and discussed the <br />conditional use permit request to allow for the construction of the 1,150 square-foot <br />garage. One resident—Terry Wiley of 2279 Oakwood Drive--appeared before the <br />Commission to voice concern that the expanded garage could lead to a commercial <br />operation or auto repair shop. The applicant indicated that he was not a mechanic <br />and the garage would not be used commercially, only for storage. The Commission <br />reviewed the adverse effects criteria as outlined in Section 1125.01, Sub. 1e, of the <br />Zoning Code and determined that the proposed use would not cause little if any <br />adverse effect to the adjoining neighbors and neighborhood in general. Based on <br />that determination, the report of staff and testimony from the applicant, the <br />Planning Commission approved Resolution 620-00, a resolution recommending <br />approval of the requested conditional use permit. This resolution is attached for the <br />Council’s reference and review. <br /> <br />Recommendation: <br /> <br />Based on the testimonies given and satisfaction of applicable requirements, Staff <br />and the Planning Commission recommend approval of Resolution 5442, a resolution <br />approving a conditional use permit for an oversized garage at 2251 Oakwood Drive, <br />subject to stipulations. <br /> <br /> <br />_____________________________________
