Mounds View City Council February 28, 2000 <br />Regular Meeting Page 26 <br />City Attorney Long advised that there were five different items forwarded for Charter <br />Commission consideration by the City Council. He indicated the Charter Commission has <br />proposed language for four of the five items. He explained that the first item pertains to the <br />ordinance which addresses City Council meetings, amending Section 3.01 of the Charter. He <br />explained that this proposal is substantially different from that proposed to the Charter <br />Commission. He advised that the Charter Commission has suggested three separate <br />subdivisions, and there is language of a substantive nature in at least one of these subdivisions <br />that is quite different from the language that was proposed. <br /> <br />City Attorney Long stated the other three items are almost exactly the same as the proposed <br />language that the Council has previously seen. He indicated that with regard to Section 3.04, the <br />Charter Commission is recommending the Council be allowed a more restrictive voting <br />requirement set by City ordinance, and this would preserve the current option in terms of a 4/5 <br />vote requirement for Conditional Use Permits, and items of this nature. <br /> <br />City Attorney Long stated the last two items pertain to the changes relating to Initiative and <br />Referendum, and the Charter Commission has simply stricken the word “resolution” in each <br />case, because of the case law presented. <br /> <br />City Attorney Long explained that under State Statutes, when amending the Charter by <br />ordinance, there is technically no first and second reading, however, the Council could consider <br />this to be the first reading, and the March 27 date could be set for the second reading and <br />adoption. He explained that City staff would provide a two-week published notice, prior to the <br />hearing. <br /> <br />City Attorney Long indicated the Council may wish to examine the first item, pertaining to City <br />Council Meetings, at a Work Session. He advised that procedurally, the Council must <br />unanimously agree to the proposed language in order for it to become an amendment to the <br />Charter. He indicated that the Council does not have the ability to modify the Charter <br />Commission’s suggestions, therefore, they would either vote down the proposal, or suggest it go <br />back to the Charter Commission with some revisions. He explained that if the item is sent back <br />to the Charter Commission, they would begin the process again, with the revisions, after which <br />they would bring the matter back before the Council for consideration. <br /> <br />Mayor Coughlin inquired if it was City Attorney Long’s recommendation to lay that item over <br />for consideration, and move to approve the other three, which are basically of a housekeeping <br />nature. <br /> <br />City Attorney Long stated this was correct.
