The variance is in harmony with the general purposes and intent of this Title. <br />b. The variance is consistent with the comprehensive plan. <br />c. The applicant proposes to use the property in a reasonable manner not permitted by <br />this Title or the City Code. <br />d. Unique circumstances apply to the property which do not apply to other properties in <br />the same zone or vicinity and result from lot size or shape, topography or other <br />circumstances over which the owner of the property since the enactment of this Title <br />has had no control. The unique circumstances do not result from the actions of the <br />applicant. <br />e. The variance does not alter the essential character of the neighborhood. <br />f. The variance requested is the minimum variance which would alleviate the practical <br />difficulties. Economic conditions alone do not const itute practical difficulties. <br />g. The Board of Adjustment and Appeals may impose such conditions upon the <br />premises benefited by a variance as may be necessary to comply with the standards <br />established by this Title or to reduce or minimize t he effect of such variance upon <br />other properties in the neighborhood and to bet ter carry out the intent of the <br />variance. The condition must be directly related to and must bear a rough <br />proportionality to the impact created by the variance. <br /> <br />To summarize the Findings in the attached Resolution, the request to decrease the side <br />yard setback from 5’ to 3.5’, to allow a parking area for an RV, is reasonable in Staff’s <br />opinion. The storage of an RV on an improved surface (e.g. concrete, asphalt, pavers, <br />or gravel) is a permitted use (criteria a). An alternative to the variance is: (1) for the RV <br />to be parked on the driveway within the front yard (currently), or (2) to be parked in the <br />rear yard. Parking the RV in the rear yard would be difficult because of topography <br />(criteria d). <br /> <br /> <br />Summary <br />The applicant is requesting a Variance to reduce the side yard setback from 5’ to 3.5’ to <br />allow a driveway to be located beside a garage, to be used to park an RV trailer. <br /> <br />A Public Hearing notice was published in the August 25, 2017 Mounds View-New <br />Brighton Sun Focus, and mailed to property owners within 350’ of the subject property <br />(49 properties). <br /> <br /> <br />Staff’s Recommendation <br />It is Staff’s opinion that the requested variance is reasonable, and recommends <br />approval of Resolution 1077-17, approving a Variance to reduce the side yard setback <br />from 5’ to 3.5’ for a driveway. <br />
