Discuss Possible Code Amendments in Chapter 1010, Wetlands

Planning Associate Heller discussed the Wetland Chapter of the City Code. She proposed a
portion of Subdivision 4 be reworded to allow for a non-conforming property to be built on
without requiring a variance. She requested comment from the Commission on the proposed
code amendment.

Commissioner Carvelli-Yu requested further clarification.

Associate Heller discussed the proposed language change in further detail. She explained that
the wetlands would still be protected through another portion of City Code.

Commissioner Elofson asked if the wetlands were regulated by the City.

Associate Heller explained that the Rice Creek Watershed governed wetlands that were an acre
or larger. The City had governance over smaller wetlands. She then discussed the wetland
buffer zone that was regulated by the City.

Chair Stevenson requested staff read Subdivision 4 for the Commission and asked where staff
was proposing changes.

Associate Heller read the language in full and proposed amending the language in Letter A.

The Commission recommended staff proceed with the proposed code amendment.
______________________________________________________________________________

B.
