Mounds View City Council Page Fourteen <br />~egular Meeting July 13, 1992 <br />the City Council approves the Wetland Alteration Permit based on <br />the City Consultant Engineer's findings that the request does meet <br />or exceed the applicable sections of the Municipal Code. <br />the Developer has requested a variance from the 100 foot wetland <br />setback requirement. <br />the City Council has reviewed this request and found that there <br />are not exceptional or extraordinary circumstances which apply to <br />this property which do not apply generally to other properties in <br />the same zone or vicinity and results from lot size or shape, <br />topography, or other circumstances over which the owners of the <br />property, since enactment of this Code, have not had control. <br />Councilmembers were polled as to their opinion. Councilmember <br />Rickaby - no, Councilmember Blanchard - yes, Councilmember Quick - <br />yes, Councilmember Wuori - yes and Mayor Linke - yes. <br />the City Council has found that the request is the minimum <br />variance which would alleviate the hardship and does not convey <br />certain privileges upon the applicant that are not enjoyed by <br />other property owners within the City. <br />• the City Council approves the variance request within the 100 foot <br />wetland setback requirement. <br />the Developer has requested a Conditional Use Permit for working <br />in a flood plain. <br />the City's Engineering Consultant, Peter Sabee, has reviewed <br />the Development Proposal and found that there is not adverse <br />affect upon the flood plain. <br />the City Council approves the Conditional Use Permit for filling <br />in a flood plain. <br />the Developer has requested vacation of City-owned right-of-way. <br />the City Council approves the requested vacation of right-of-way. <br />the Developer has requested that property be accepted in lieu of <br />the Park Dedication Fee. <br />the City Council does not accept land in lieu of Park Dedication <br />Fee. <br />the Mounds View Planning Commission has reviewed the proposal and <br />recommended approval in Resolution No. 339-92. <br /> <br />
