Variance Extension Request for Tyson Company, 4825 Mustang Circle <br /> <br />Planning Associate Heller reported that in 2006, the Tyson Company applied for a development <br />review and a variance to build an additional building on their property. She stated the variance <br />request was for a reduced front building setback (a ten-foot building setback) and a five-foot <br />parking setback. She stated that due to the large wetland area in the rear of the property, the <br />proposed building and parking lot were pushed much closer to the street than the 40 feet required <br />by code. She reported that on August 2, 2006, the Planning Commission approved a variance for <br />these reduced setbacks <br /> <br />Planning Associate Heller stated that per City Code Chapter 1125.02 Subd. 5, all variances must <br />be acted on within one year from the date of approval or they become null and void, unless an <br />extension is granted by the Planning Commission. She reported the Tyson Company submitted a <br />written request for a one-year extension. <br /> <br />Planning Associate Heller stated that soon after the variance was granted, Tyson began working <br />with Ferrellgas to possibly locate on Tyson’s property, and then Tyson decided the cost of <br />constructing a new building was too high and that they would not proceed with their own <br />expansion plans. She reported the new site plan showing where Ferrellgas would be located, is <br />exactly where Tyson planned their new building to be located. She stated that Tyson indicated <br />construction costs have come down and if Ferrellgas did not locate on their property, they would <br />probably move forward with new building plans again. <br /> <br />Planning Associate Heller stated staff requests the Planning Commission to consider a one-year <br />extension of a variance for reduced building and parking setbacks at Tyson Company, 4825 <br />Mustang Circle. <br /> <br />Commissioner Gunn asked if both buildings would be used. <br /> <br />Planning Associate Heller replied they would use them both. <br /> <br />Commissioner Miller asked if the extension could be approved if the Ferrellgas is an unknown. <br /> <br />Chair Stevenson explained the Planning Commission is extending the variance for Tyson <br />Company only. <br /> <br />Commissioner Cramblit asked if they could ask for another extension next year. <br /> <br />Planning Associate Heller replied they could. <br />
