<br />City of Mounds View <br />1125.02 1125.03 (Rev. 2/04) <br /> <br /> <br /> b. Review Procedures: The Director of Community Development will review <br />administrative variance requests. In order to be approved, the variance request must meet <br />the hardship criteria as stated in Section 1125.2, Subdivision 2. If hardship is evident and <br />approval is granted, the adjacent property owners must be notified by mail of the <br />preliminary approval and allowed ten (10) days to respond to the decision. Absent any <br />opposition from adjacent property owners, the Planning Commission shall review the <br />administrative variance request at the following regularly scheduled meeting. (Ord. 725, 2- <br />9-04) <br /> <br />c. Denial and Appeals: If the Director chooses to deny a request, or if either the adjacent <br />neighbors or the Planning Commission disagrees with administrative approval of a variance <br />request, the request is denied administratively and the applicant may choose to request a <br />formal variance from the Planning Commission. (Ord. 725, 2-9-04) <br /> <br />d. Fees: Administrative variances fees are set according to the fee schedule adopted by City <br />Council resolution. (Ord. 725, 2-9-04) <br /> <br /> <br />1125.03: CERTIFICATE OF OCCUPANCY: <br /> <br />Subd. 1. Application: A certificate of occupancy shall be obtained before: <br /> <br /> a. Any building hereafter erected or structurally altered is occupied or used. <br /> <br /> b. The use of any such building is altered. <br /> <br />Subd. 2. Procedure: <br /> <br /> a. A certificate of occupancy shall be issued after the Building Inspector has found that the <br />erection or alteration of such building or part thereof has been completed in conformity with <br />the provisions of this Title and all applicable building codes1. <br /> <br /> b. Pending the issuance of such a certificate, the Building Inspector may issue a temporary <br />certificate of occupancy for a period not exceeding six (6) months during the completion of <br />the erection or alteration of such building. Such temporary certificate shall be issued only <br />upon submission of satisfactory assurance to the Building Inspector that the erection or <br />alteration work shall be completed within six (6) months. The temporary certificate shall <br />not be construed as in any way altering the respective rights, duties or obligations of the <br />owners or of the City relating to the use or the occupancy of the premises or any other <br />matter except under such restrictions and provisions as will adequately insure the safety of <br />the occupants. <br /> <br /> 1 See Title 1000 of this Code.
