Page 4 <br />August 12, 1996 <br />Mounds View City Council <br />VOTE: 5 ayes 0 nays Motion Carried <br />RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR. <br />Mayor Linke explained that this portion of the meeting was designated for anyone who wished to speak to <br />the Council on items that were not on the Agenda. <br />Duane McCarty,' 8060 Long Lake Road, stated he had an opportunity to review a July meeting of the City <br />Council wherein a discussion was held regarding a request he had made to the City Council at an earlier <br />date in regard to the Anoka County Airport. He feels there is one issue that is being sidestepped. He <br />- noted that in 1980 a State Iaw was passed (MN Statutes 473.641, Subd. 4) which states "Notwithstanding <br />any other law, the Metropolitan Airports Commission shall not use revenue from any source (that <br />described by Section 473.608) for construction of air facilities to expand or upgrade the use of an existing <br />Metropolitan airport from minor use to intermediate use status as defined by the Metropolitan <br />Development Guide, Aviation Chapter, adopted pursuant to Section 473.145. This states that the <br />instrumentation at minor airports would be listed as non-precision. He stated the 19801aw which is still <br />in effect today and was in effect at the time that the city and the Metropolitan Airports Commission <br />negotiated a Decree, which incorporated an instrument landing system, and therefore violated state law. <br />He wondered if the court was aware that this agreement violated State law. <br />• Mayor Linke explained that a date was stipulated for the development guide in the agreement, and pursuant <br />to that section, changes can be made to that development guide. <br />Mr. McCarty stated he did not think that the law was meant to be flexible enough to encompass all future <br />actions, when it specifically states "as defined by the Metropolitan Development Guide" (and there was <br />only one development guide at that time}. The same development guide was in effect at the time of the <br />1980 law as was in effect at the time of the 1986 agreement. <br />Mayor Linke stated at a Council work session, the City Attorney was instructed to review it and come <br />back to the Council with their recommendations. At this time, he has not received that information from <br />the attorneys. <br />PUBLIC HEARINGS: <br />Public Hearing Considering the 1997 Long Term Financial Plan. <br />Mayor Linke opened the Public Hearing at 7:25 p.m. <br />Mr. Bruce Kessel, Finance Director, presented information showing the 1996 budget for capital outlays as <br />well as the preliminary 1997 budget and those projected through 2002. This information is based upon <br />input from various departments who went through and prioritized items to determine what items will need <br />to be completed next year and which can be put off until future years. With this information, the city will <br />attempt to coordinate the long term capital plan with the operating budget to lessen the impact on property <br />taxes and to make sure that there are funding sources for all of the identified city projects. It was noted <br />that the figures presented were very preliminary and that there would be significant changes before it <br />becomes fmal. <br />
