The
property was inspected on December 27, 1996 by City Inspector Rick Jerson. Auer having a number of
problems with moisture build-up on his roof and leaks, he has been told by various contractors that his roof is
not up to code. He has talked with Mr. Jerson in regard to these problems. Mr. Harris stated he would like
an official response from the city as to when he can expect this problem to be resolved. He noted that he
spoke with the League of MN Cities Representative, Bob Weisbrode, who is doing some research to see if the
city is liable.
In response to Mr. Harris' comments, Attorney Bob Long explained that there is a statute on the books which
holds cities harmless on inspections, due to the fact that inspectors are not always able to spot
problems at the time of inspections. He talked with Mr. Fred Drive from the State Department Building Code
and Rick Jerson is currently in the process of preparing a corrective letter to the previous owners, based on his
re-inspection on May 14, 1997, where he will outline the areas on non-compliance. The corrective order will
give the previous owners 30 days to bring the property into compliance or he will be in violation of the code,
which is a misdemeanor offense. The city will keep Mr. Harris informed as to the status.
There were no Public Hearings scheduled for this meeting.
COUNCIL BUSINESS•
A.
