Page 5 <br />all ten municipalities remained members of the Commission. <br />Additionally, the withdrawing municipality shall receive a pro rata <br />share of any portion of the $650,000 payment made to the <br />Commission which the Commission has not specifically designated <br />fro the repair or replacement of equipment or facilities. <br />Impact of Withdrawal from NSCC <br />Service Impacts <br />• Oversee, administer, and negotiate the franchise. <br />Separate from the NSCC 10 -city group, Mounds View would need to retain legal <br />counsel with relevant experience to assist with the 2013 franchise renewal. There <br />are not many law firms specializing in cable franchises so the options would likely be <br />few. One option would be Bradley & Guzzetta, LLC, the current representation for <br />the Commission. In 2009, NSCC budgeted legal fees at $39,000. It is unclear how <br />this would scale to serve one city instead of ten. Another law firm with a national <br />telecommunications practice is Miller & Van Eaton, PLLC. <br />• Scholarship fund. <br />NSCC budgeted $102,052 in 2010 as grants from Comcast to support internships <br />and scholarships. At the May 2010 NSCC meeting, the Scholarship Committee <br />announced awards of $48,000 in scholarships for the year. Of this, $6000 went to <br />Mounds View residents. If a pro rated portion of the funds were available to Mounds <br />View separately, the City could provide a scholarships and/or internships to qualified <br />resident(s). <br />Additional Available Funding <br />• Retain Franchise Fees <br />Upon withdrawal from NSCC, Mounds View would retain the portion of the franchise <br />fees that had been provided as support for NSCC. In 2009, Mounds View received <br />$111,747.92 in franchise fees, and made a 2010 contribution of $26,933.36 to <br />NSCC. With the change in allocation of expenses between NSCC/NSAC to 80/20, <br />the city contribution for 2011 would be decreased by approximately $2000. <br />• Pro Rata Share of any portion of the $650,000 payment made to the Commission <br />which the Commission has not specifically designated for the repair or replacement <br />of equipment or facilities. <br />This funding was designated at the start of the franchise for capital expenses, and it <br />is doubtful that much, if any, available funds remain. Mounds View could receive <br />approximately 8% of the remaining amount. <br />Impact of Withdrawal from NSAC <br />Service Impacts <br />• Access to NSAC Resources <br />Withdrawing from the joint powers groups would make Mounds View not eligible for <br />many of the resources NSAC makes available to qualified persons. <br />o Access to digital production truck for sophisticated remote events (example: <br />parade). <br />The truck would be hard to replace. Technically, NSAC is open to volunteers <br />
