Item No: 08A <br />Meeting Date: August 27, 2018 <br />Type of Business: Council Business <br />City Administrator Review: _____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: Public Hearing: Consideration of Resolution 8990, to <br />Approve a Chicken/Duck Keeping License for Rebecca <br />O’Donnell, 8145 Red Oak Drive <br /> <br />Introduction: <br /> <br />The Mounds View City Council passed Ordinance 903, which amended Chapter 701 of the <br />City Code, to provide for limited and controlled raising and keeping of chickens and/or <br />ducks on properties zoned R-1, Single Family Residential. Residents are limited to no more <br />than eight (8) birds restricted to only backyard areas. This Ordinance became effective on <br />August 3, 2015. <br /> <br />Background: <br /> <br />Applicant Rebecca O’Donnell of 8145 Red Oak Drive has submitted an application to raise <br />and keep eight chickens on her property. Attached is the application for the City Council’s <br />consideration. It appears Ms. O’Donnell meets all requirements under Ordinance 903. <br /> <br />In accordance with Ordinance 903, initial applications shall be considered by the City <br />Council after holding a public hearing. Renewals may be approved administratively unless <br />the City has received substantial complaints or related violations have been documented <br />during the previous year. In addition, the City requires that backyard areas within which the <br />chickens are allowed to roam must be fenced. A site inspection conducted on August 15th <br />indicated that a fence was not present. However, the owner has indicated that the fence <br />will be installed by the end of August. A zoning permit is required for this work. <br /> <br /> Staff has published a public hearing notice in the August 17, 2018 edition of the Sun Focus, <br />the City’s official newspaper. In addition, as required, notices were mailed to residents <br />within a 350 feet of 8145 Red Oak Drive. <br /> <br />Recommendation: <br /> <br />Staff recommends opening this public hearing for public comment and recommends <br />approval of this license request pending the installation and final inspection of the required <br />fence.
