Mounds View City Council <br />December 14, 1998 <br />Page 11 <br />City Attorney Long recommended: In paragraph four of the resolution, state: "The applicant <br />shall pay a park dedication in an amount equal to 10 percent of the fair market value of the land <br />as determined by an appraisal. And then you can have an appraisal come in between now and the <br />final plat and its going to be 10 percent of whatever that appraisal is." <br />Mayor McCarty closed the City Council meeting and opened the public hearing. <br />No public comments were consider. Mayor McCarty close the public hearing and reopened the <br />City Council meeting. <br />MOTION/SECOND: Mayor McCarty/ -------- to approve Resolution 5286, Approving a <br />Preliminary Plat for the Anthony Properties Addition, with the changes in Item four as stated by <br />the City Attorney: Before the final plat is approved by the City, the applicant shall have paid a <br />park dedication fee in the amount of 10 percent of the market value of the land as determined by <br />an appraisal. <br />The motion failed due to a lack of a second. <br />MOTION/SECOND: Gunn/Koopmeiners to approve Resolution No. 5286, Approving a <br />Preliminary Plat for the Anthony Properties Addition. <br />VOTE: Ayes - 5 Nays - 0 The motion carried. <br />K. Consideration of Resolution No. 5288 for Silver Lake Commons Agreement. <br />City Attorney Long noted that the first document that the City Council had approved was called <br />the "Initial Agreement." This agreement called for a housing development agreement, a <br />management agreement, and a regulatory or operating agreement, all of which were designed to <br />protect the interests of the City. Closing on the project is scheduled for the week of December <br />21, 1998. <br />Staff was recommending approval of Resolution 5288 Authorizing the Mayor to enter into the <br />stated agreements on behalf of the City of Mounds View. <br />MOTION/SECOND: Koopmeiners/Gunn to approve Resolution No. 5288 for Silver Lake <br />Commons. <br />VOTE: Ayes - 4 Nays - 1 (Stigney) The motion carried. <br />L.
