It is only going to get worse with this <br />nice street that is going to be put in. Nayes - 0. <br />RESUME MEETING <br />Mayor Coughlin calls the meeting back to order. <br />Mr. Quick requests Mr. Long what legal ramifications what the <br />City could incur on the intersection. <br />Mr. Long stated it is a call of where the developer has obviously <br />raised the issue that if there is a delay whether it is one week <br />or longer, if they suffer some economic damage, they would at <br />least maintain their option to seek remedies from the City and <br />have claims like that against cities. Some have been successful <br />and some have not. In fact, the vast majority are not. The <br />issue is really a question of whether or not the delay would be <br />considered a reasonable delay, whether or not it would be a good <br />faith basis for it, so it is really quite a factual <br />determination.
