MOUNDS ]VIEW <br />MEMORANDUM <br />to: Mounds View City Council <br />from: Nyle Zikmund, City Administrator <br />re: Item 7 - 2817 Bronson (Complainant) & 7501 Groveland (Complaint Against) <br />date: May 1, 2019 <br />Executive Summary: <br />Residential complaint against adjacent neighbor doing car repair and using wood heat in garage. <br />Complainant disturbed by noise, fumes and parking as well as smoke from wood stove. See full <br />report below. Car repair operation and stove are, practically speaking all code compliant. <br />However, the wood burning stove smoke is an irritant as it prohibits complainant from parking <br />their RV in its traditional spot given close proximity to smoke and subsequent odor impact to RV. <br />This is the only complaint we have from one resident against another specific to a home occupation <br />doing automobile repair. <br />Options: <br />Options for council are limited to amending code to disallow any auto repair business (generating <br />revenue) from operating in a residential setting. <br />History: <br />November 5 2018 — Annette Hurtado and behalf of herself and her wife Susan Gaertner appeared <br />at Council Workshop to share/discuss neighbor at 7501 Groveland who was operating an <br />automobile repair shop. <br />Fall/Winter — Jacob had numerous conversations and exchanges with her. <br />April 24, 2019 — Annette emails council with numerous concerns (addressed below) <br />April 25, 2019 — Administrator Zikmund travels to site at 4:15 AM until 4:45 AM accompanied by <br />Officer Aase. We do not witness any on -street parking violations. Later that morning (8:15 am to <br />10:00 AM) Zikmund meets with Annett and Susan and resident of 7501 — Steve — who the alleged <br />complaints are against. <br />I spoke with Annette and Susan, then proceeded on foot to 7501 where I spoke with Steve for <br />approximately 20/25 minutes and he allowed me to see and observe his operation and then I <br />returned to 2817 Bronson and visited with Annette and Susan again and covered the following; <br />1. 607.01 Subd. 5 Junk — advises her that the wood pallet, tarp and front end of a car are in <br />fact violations but not so egregious as to warrant an action. <br />a. Both the tarp and pallet were newer/not deteriorated and minimally meet the <br />definition of junk. <br />
