2. 607.01 Subd. 8 and 10 improved surfaces — They do in fact have class 5 in the rear of their <br />garage for parking the motor home and Steve did move his cars onto the driveway and that <br />while the boat is in fact in violation, we are not enforcing that anywhere in the city and are <br />in the process of updating that section of code. Steve did park cars on the grass but no <br />longer does so. <br />a. Steve admitted the four cars parking on his driveway were ones he purchased, fixed <br />up and intends to sell. State law regulates this if he does more than 5 per calendar <br />year which would require him to obtain a Dealers License — see next section. <br />3. 607.02 Subd 1 and 2 — Parking on the Street — <br />a. Officer Aase and I did not witness, PD does 1 and sometimes 2 sweeps per month. <br />I advised her to call 911, declare non -emergency and report any violations. I also <br />gave her my cell phone number and told her to call me if she witnesses street <br />parking violations. She also detailed noise from pneumatic tools, paint sprayers, <br />etc. During my visit (which was unexpected) I found a very neat, tidy operation <br />with no pneumatic tools other than an air chuck for filling tires. There is no body <br />work or painting going on, mechanical repair only. The only tool I observed that <br />would make noise is a battery riven drill impact wrench. Steve also indicated his <br />work hours are between 8 and 5, occasionally going into the evening but never past <br />10. I did not address the foul language as there is no law or code prohibiting that. <br />4. 607.03 Subd.1 — Public Nuisance — Specifically his wood burning stove which I observed <br />to be very small and he only had firewood, kindling, and brown craft paper. Complainants <br />had video of when he was burning, presumably starting up and the smoke was white. <br />a. I believe this to be a major issue and Annette states this is the straw that broke the <br />camel's back as the stove location is in close proximity to the parking pad for the <br />RV and while I assured Annette there was little cause for concern specific to fire, it <br />would in fact cause the motor home to stink if it sat there all winter. I suggested to <br />Steve, strongly, that he might consider being a "good neighbor" by installing a gas <br />furnace. <br />5. 607.06 — Unlawful Parking and Storage <br />a. They allege decrease of property value which I did not address nor is there any <br />means to accurately assess. <br />6. 607.08 Subd. 1— Loud noise <br />a. Did not witness nor see anything that would make a loud noise other than the <br />impact wrench. I did share with complainant that they were the only complaint in <br />the area and that Steve stated he serviced/repaired the vast majority of the <br />neighbor's cars in the area, sans the complainant. <br />7. Uses Prohibited <br />a. Complainant does not believe auto repair business should be allowed in residential <br />area. I advised that was a council decision and would be sharing a report with them. <br />8. 1103.10 — Smoke, Dust, Odors <br />a. There is no evidence of painting nor did I see a welder. I discussed this with Steve <br />and he stated that he uses on solvent which does have an odor but the use is limited <br />and in small quantity. I shared this with the complainant. <br />9. 1103.11 —Noise <br />a. Already addressed <br />10. 1103.12 — Refuse <br />a. Already addressed <br />
