11. 1103.13 — Storage <br />a. Shared with them that directly across the street in front of their house was a home <br />with 6 cars, 4 of them clearly in some state of junk or repair and that they had not <br />filed a complaint against that property. <br />We finished the discussion with me asking what they wanted to happen to which they responded, stop <br />the repair business and quit burning. I offered that the stove and garage were all code compliant and <br />that the smoke in fact did prohibit them from parking their RV there if they did not want it to smell but <br />there simply was no code provision preventing this. As to the operation, I stated I would follow up <br />with council on allowing auto repair and would investigate Steve operating as a "Automobile Dealer" <br />which as indicated above, he is on the cusp of doing. <br />Minnesota Statute: <br />Minnesota Statute does regulate auto sales and addressed both new and used and sets forth the <br />following regulations: <br />May buy, sell, lease, broker, wholesale or auction any make of used vehicle. <br />Requirements: <br />- Commercial Building <br />- Display Area for a Minimum of 5 Vehicles. <br />- Zoning Approval <br />- Surety Bond <br />- Liability Insurance <br />- Signage <br />- Posted hours of operation. <br />*A separate license is required for any location in a county other than the one listed on initial <br />application for license. <br />A person could not obtain a Dealer's License to operate from their home, unless the property were <br />commercial (e.g. home is a non -conforming use within a commercial district). Thus, the intent is for <br />Steve to stay at 5 or fewer vehicle sales per year. The State's intent is to prevent cases like Steve's, <br />from happening. <br />
