Item No: 06 <br />Meeting Date: Jun 3, 2019 <br />Type of Business: WS <br />City Administrator Review: _____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund <br />Item Title/Subject: Charter Commission Members <br /> <br /> <br />Discussion: <br />Turnover on the Charter Commission has been an issue for more than a decade and one of <br />serious concern. In fact other than for a few months in the latter part of 2018 and in 2019 until <br />Chair Reyes-Johnsons resignation May 21st the Commission did not have their full complement <br />of members since 2002. <br /> <br />Included in the packet materials are spreadsheets detailing the membership and their years of <br />service since 1999, details on number of meetings, meetings cancelled due to lack of quorum, <br />meetings held despite not having a quorum, minutes of the May 21, 2019, and a chronological <br />history of Commission events dating back to 2002. <br /> <br />As council is aware, Chair Reyes-Johnson resigned shortly after her second meeting. I was also <br />informed by two members of their intention to resign unless changes are made. <br /> <br />Attorney Riggs will be attending the workshop meeting to provide clarification on the options <br />related to charter commission members who are appointed by the judiciary. In short, the statute <br />does allow the Council (or Commission) to request the court that a member be removed. Council <br />also has the option of waiting for a term to expire and advise the Judge of their wish for a different <br />member. <br /> <br />Based on the research provided along with recent events It is staff’s opinion that absent a change <br />in membership, the turnover of commission members will remain an issue. Furthermore, the <br />behaviors demonstrated by some commission members are inconsistent with the <br />values/expectations of the Council and in fact, the Code of Ethics adopted by the Commission at <br />their May 21, 2019 meeting. <br /> <br />Respectfully, <br /> <br /> <br /> <br /> <br />Nyle Zikmund <br />City Administrator
