Item 05A <br />Page 3 of 6 <br />Summary <br />Ron O'Connell is requesting a Variance to allow a V side yard setback for a driveway, such that <br />the driveway aligns with an existing retaining wall. <br />A Public Hearing notice was published in the June 5, 2019 New Brighton — Mounds View <br />Bulletin, and mailed to property owners within 350' of the subject property. <br />Staff received an email from the neighbor, adjacent to the driveway, who is in support of the <br />Variance. <br />Recommendation <br />Staff recommends Denial of the Variance request. It is Staff's opinion that there are not unique <br />circumstances to the property, and that there is no hardship. Staff is supportive of a Variance <br />for a 3' side yard setback, such that the driveway aligns with the driveway apron. <br />The Planning Commission is requested to conduct a Public Hearing, and consider the following <br />options: <br />1. Resolution 1101-19, approving the Variance to allow a 1' driveway setback. <br />2. Resolution 1101-19, denying the Variance to allow a 1' driveway setback. <br />3. Table the request. If additional information is needed before a decision can be rendered or <br />if more discussion is needed, the Commission can simply move to table the request until <br />such information has been provided. Because of the 60 -day requirements (Deadline: July <br />24, 2019), the Commission would need to act upon the request as soon as reasonably <br />possible to avoid an inadvertent approval. <br />If the Commission chooses to pursue Staff's recommendation (3' setback), a Resolution should <br />not be considered without the consent of the Applicant. <br />Respectfully submitted, <br />Jon Se`Ga'I , ICP <br />Community Development Director <br />Attachments <br />1.
