Item 05A
Summary
Ron O'Connell is requesting a Variance to allow a V side yard setback for a driveway, such that
the driveway aligns with an existing retaining wall.
A Public Hearing notice was published in the June 5, 2019 New Brighton — Mounds View
Bulletin, and mailed to property owners within 350' of the subject property.
Staff received an email from the neighbor, adjacent to the driveway, who is in support of the
Variance.
Recommendation
Staff recommends Denial of the Variance request. It is Staff's opinion that there are not unique
circumstances to the property, and that there is no hardship. Staff is supportive of a Variance
for a 3' side yard setback, such that the driveway aligns with the driveway apron.
The Planning Commission is requested to conduct a Public Hearing, and consider the following
options:
1. Resolution 1101-19, approving the Variance to allow a 1' driveway setback.
2. Resolution 1101-19, denying the Variance to allow a 1' driveway setback.
3. Table the request. If additional information is needed before a decision can be rendered or
if more discussion is needed, the Commission can simply move to table the request until
such information has been provided. Because of the 60 -day requirements (Deadline: July
24, 2019), the Commission would need to act upon the request as soon as reasonably
possible to avoid an inadvertent approval.
If the Commission chooses to pursue Staff's recommendation (3' setback), a Resolution should
not be considered without the consent of the Applicant.
Respectfully submitted,
Jon Se`Ga'I , ICP
Community Development Director
Attachments
1. Resolution 1101-19, Denying Variance for 1' setback
