<br />RESOLUTION DENYING A RENTAL DWELLING LICENSE, AND AUTHORIZING AN
<br />ORDER TO VACATE THE PREMISES OF 5067 IRONDALE ROAD, DUE TO
<br />VIOLATIONS OF MOUNDS VIEW CITY CODE, CHAPTER 1012 (RENTAL
<br />DWELLING LICENSE)
<br />WHEREAS, Mounds View City Code, Section 1012.03, Subd 1 states; "No person
<br />shall allow to be occupied or let to another for occupancy any rental dwelling unit, unless
<br />the owner has first obtained a rental dwelling license."; and,
<br />WHEREAS, the property owner of 5067 Irondale Road, Sean Haller, a licensed
<br />Resident Real Estate Salesperson, purchased the single-family home on July 27, 2017;
<br />and,
<br />WHEREAS, in an effort to enforce the City's Rental Dwelling License ordinance,
<br />Staff compared licensed rental properties to non -homestead properties, finding that 5067
<br />Irondale Road was neither licensed, nor homesteaded. In April, 2018, Staff conversed
<br />with residents of 5067 Irondale Road, finding it to be occupied by renters; and,
<br />WHEREAS, the City mailed a notice to the property owner, Sean Haller, on
<br />October 2, 2019, requiring a response by October 31, 2019, of a Rental Dwelling License
<br />Application, or a Rental Dwelling License Exemption Affidavit. No response was
<br />received; and,
<br />WHEREAS, Since 2017, the Mounds View Police Department and other law
<br />enforcement agencies, have responded to 32 calls of service to this property, including
<br />burglary, armed robbery, and shots fired, in addition to aggravated robberies committed
<br />within the area by persons who reside at, or are associated with residents of 5067 Irondale
<br />Road. The home is within the attendance walking area of a middle school and high
<br />school, and less than'/2 mile from an elementary school. Activities at this property, and/or
<br />by its occupants have created a public nuisance onto the neighborhood and the larger
<br />community, and is the most concerning property within the City; and,
<br />WHEREAS, the City Noticed the property owner, Sean Haller, of this Hearing, via
<br />US Mail, and Certified US Mail (postmarked November, 7, 2019), and made attempts to
<br />personally serve Notice, prior to the November 12, 2019 Hearing date; and,
