Resolution 9212 <br />Page 2 of 5 <br />WHEREAS, Staff distributed plans, most recently dated December 10, 2019, to <br />applicable departments and agencies for review, receiving written comments from: <br />Joe Lux, Ramsey County Public Works <br />Kelsey White, Rice Creek Watershed District <br />Nick Henly, Mounds View <br />Charlie Smith, SBM Fire Department <br />Tyler McLeete, Stantec <br />November 8, 2019 <br />November 8, 20019, December 5, 2019 <br />December 12, 2019 <br />December 12, 2019 <br />December 12, 2019 <br />These comments have been incorporated into the Conditions of Approval, as appropriate; and, <br />WHEREAS, the Mounds View Planning Commission reviewed the request on <br />December 18, 2019, approving Resolution 1111-19, recommending approval with conditions; <br />and, <br />WHEREAS, the Mounds View City Council conducted a duly noticed Public Hearing on <br />January 13, 2020; and, <br />WHEREAS, the Mounds View City Council has reviewed the Staff Report, submitted <br />plans, and has compared the request to City Code, Section 1125.01, subd 3 (Criteria for Granting <br />Conditional Use Permits), and in consideration of public testimony, makes the following <br />Findings of Facts (italics): <br />1. The use will not create an excessive burden on existing parks, schools, streets and other <br />public facilities and utilities which serve or are proposed to serve the area. <br />Finding: The proposed car wash will not create an excessive burden on existing <br />public facilities and utilities; <br />2. The use will be sufficiently compatible or separated by distance or screening from <br />adjacent residentially zoned or used land so that existing homes will not be depreciated in <br />value and there will be no deterrence to development of vacant land. <br />Finding: The adjacent land to the north is residentially zoned, and consists of a <br />church, wetland, and wooded area. The nearest homes back up to <br />Bronson Drive, and are over 200' away, and screened by existing wooded <br />areas on residential and church property, and a tree line on City Property <br />Public Works Facility). The car wash should have no effect on area <br />property values. <br />3. The structure and site shall have an appearance that will not have an adverse effect upon <br />adjacent residential properties. <br />Finding: The appearance of the structure and site should have no effect upon <br />adjacent residential properties.
