Resolution 1108-19 <br />Page 5 of 7 <br />with Minnesota Building Code Mechanical Systems, Chapter -134.5. <br />C. All animal boarding activities shall be conducted indoors, except for necessary <br />outdoor exercise. At no time shall any animal be left unsupervised while outdoors. <br />d. Outdoor exercise shall be conducted so as not to unreasonably annoy, injure or <br />endanger the health, safety, comfort, or welfare of the public. <br />e. All animal boarding facilities shall comply with the Nuisance Codes established for <br />the City of Mounds View. <br />f. All animal boarding facilities shall comply with the Minnesota Pet and Companion <br />Animal Welfare Act (Minnesota Statutes, 346.35 — 346.44). <br />Subd. 5. Pet stores; provided, that: <br />a. Noise and odor are effectively confined to the premises in accordance with <br />Chapter 604 of this Municipal Code, Nuisances. <br />b. The boarding of animals is prohibited, except for the purposes of retail sales. <br />C. A mechanical ventilation or exhaust system shall be installed to control, capture and <br />remove emissions or odors generated by such use. Such systems shall be separate from the <br />other ventilation systems in the building. Such system shall be designed to prevent the <br />migration of emissions or odors to other parts of the building. Installation must comply <br />with the Minnesota State Building Code Mechanical Systems, Chapter 43451346. <br />SECTION 8. The City Council of the City of Mounds View hereby amends Title 1100, Chapter <br />1123, Section 1123.03 of the Mounds View Municipal Code by deleting the str"ematerial and <br />adding the double -underlined material as follows: <br />1123.03: DISCONTINUANCE OF NONCONFORMING USE: Whenever a lawful <br />nonconforming use of a structure or land is discontinued for a period of six «' me" <br />�e , any future use of said structure or lands shall be made to conform with the provisions of <br />this Title. <br />SECTION 9. The City Council of the City of Mounds View hereby amends Title 1100, Chapter <br />1123, Section 1123.07 of the Mounds View Municipal Code by deleting the striven material and <br />adding the double -underlined material as follows: <br />1123.07: DAMAGE AND DESTRUCTION: If, at any time, a nonconforming building, <br />structure or use shall be destroyed to the extent of more than fifty percent (50%) of its fair market <br />value, as_ indicated in records of t11e ^^I assessor at the time of dams and no building <br />permithaLb= aMlied for within 180 days QLw—hen the ro a an f <br />61111 ,. . <br />623264v1MU210-54 <br />
