623264v1MU210-54 5 <br />Subd. 5. Pet stores; provided, that: <br /> <br /> a. Noise and odor are effectively confined to the premises in accordance with <br />Chapter 604 of this Municipal Code, Nuisances. <br /> <br /> b. The boarding of animals is prohibited, except for the purposes of retail sales. <br /> <br /> c. A mechanical ventilation or exhaust system shall be installed to control, capture and <br />remove emissions or odors generated by such use. Such systems shall be separate from the <br />other ventilation systems in the building. Such system shall be designed to prevent the <br />migration of emissions or odors to other parts of the building. Installation must comply <br />with the Minnesota State Building Code Mechanical Systems, Chapter 13451346. <br /> <br />SECTION 8. The City Council of the City of Mounds View hereby amends Title 1100, Chapter <br />1123, Section 1123.03 of the Mounds View Municipal Code by deleting the stricken material and <br />adding the double-underlined material as follows: <br /> <br />1123.03: DISCONTINUANCE OF NONCONFORMING USE: Whenever a lawful <br />nonconforming use of a structure or land is discontinued for a period of six (6) months more than <br />one year, any future use of said structure or lands shall be made to conform with the provisions of <br />this Title. <br /> <br />SECTION 9. The City Council of the City of Mounds View hereby amends Title 1100, Chapter <br />1123, Section 1123.07 of the Mounds View Municipal Code by deleting the stricken material and <br />adding the double-underlined material as follows: <br /> <br />1123.07: DAMAGE AND DESTRUCTION: If, at any time, a nonconforming building, <br />structure or use shall be destroyed to the extent of more than fifty percent (50%) of its fair market <br />value, as indicated in the records of the county assessor at the time of damage, and no building <br />permit has been applied for within 180 days of when the property is damaged, any future use of <br />said structure or lands shall be made to conform with the provisions of this Title. said value to be <br />determined by the Council, then, without further action from the Council, the building and the land <br />on which such building was located or maintained shall, from and after the date of said destruction, <br />be subject to all the regulations specified by these zoning regulations for the district in which such <br />land and buildings are located. Any building which is damaged to an extent of less than fifty <br />percent (50%) of its value may be restored to its former extent if the reconstruction is completed <br />within twelve (12) months after the date of destruction. Estimate of the extent of damage or <br />destruction shall be made by the Building Official. <br /> <br />SECTION 10. The City Council of the City of Mounds View hereby amends Title 1100, Chapter <br />1125, Section 1125.01, Subdivision 1(j) of the Mounds View Municipal Code by deleting the <br />stricken material and adding the double-underlined material as follows: <br /> <br /> j. Four-Fifths Vote: Amendments of this Title, or to the Official Zoning Map that <br />change all or part of an existing residential zoning district to either commercial or industrial shall <br />require passage by a four-fifths (4/5) vote of the full City Council.
