MEMO TO: PARKS AND RECREATION COMMISSION <br />FROM: MARY SAARION, DIRECTOR <br />PARKS, RECREATION & FORESTRY <br />DATE: JANUARY 18, 1994 <br />SUBJECT: NETTING FOR GREENFIELD PARK BASEBALL FIELD <br />This is memo to inform you that the City Council has approved the <br />carry over of 1993 Recreation Activity funds for the purchase and <br />installation of netting at Greenfield Park baseball field. The <br />number of foul balls landing in adjacent properties owners back <br />yards is really becoming an embarrassment. In fact, the <br />homeowner whose window was broken still has not received payment <br />by the MVAA for replacement. Mary and I have suggested several <br />times that the MVAA charge a little extra to have as a capital <br />improvement fund or equipment replacement fund for circumstances <br />such as this window affair and for reasons similar to the LLLL <br />initiative. Unfortunately the MVAA has not seen this as a need. <br />Perhaps we should discuss whether or not we see this as a <br />problem, the potential liabilities of the City and possible <br />actions that we can initiate to prevent future problems. <br />As you recall we have suggested netting as a capital item in the <br />budget. This item has not survived the budget because the <br />Council has felt that the MVAA should make some contribution to <br />the improvement since they are the offending group and the <br />primary group using this facility that the City initially <br />contributed $30,000 to its development. I too believe that it <br />would be nice if the associations using the facility would <br />contribute to its cost. However, I do think that the City is <br />liable for damages that occur simply because it is a City <br />facility. Also, I believe that the City gets a black eye in such <br />circumstances regardless if it is our program or not simply <br />because it is perceived to be a function of the City. Finally, I <br />believe that we can make a good faith effort to alleviate the <br />problem. For this reason the netting has been ordered, to be <br />funded with receipts of the Recreation Activity Fund. <br />We need to discuss what we will require of youth associations <br />using City facilities - liability insurance, contributions for <br />improvements, damage control monies up front, etc.???? <br />
