55 <br />Section 4.10 Victim or Witness Leave <br /> <br />An employer must allow a victim or witness, who is subpoenaed or requested by the <br />prosecutor to attend court for the purpose of giving testimony, or is the spouse or <br />immediate family member (immediate family member includes parent, spouse, child or <br />sibling of the employee) of such victim, reasonable time off from work to attend criminal <br />proceedings related to the victim’s case. <br /> <br />Section 4.11 School Conference Leave <br /> <br />Employees who work an average of 20 or more hours per week and have worked for the <br />City for at least a year may take up to 16 hours during any 12 month period to attend <br />school-related activities of the employee’s child if under the age of 20 and still attending <br />school provided the conference or classroom activities cannot be scheduled during non- <br />work hours. When the leave cannot be scheduled during non-work hours and the need <br />for leave is foreseeable, the employee must make a reasonable effort to schedule the <br />leave so as to not disrupt the operations of the City. Employees may choose to use <br />vacation leave time for this event but are not required to do so. If the employee’s child <br />receives child-care service as defined in Minnesota Statutes § 119B.01, subd. 2 or <br />attends a pre-kindergarten regular or special education program, the employee may use <br />the leave time to attend an activity or to observe or monitor the services or program. The <br />leave is only available if the activity cannot be scheduled during non-work hours. <br />Employees must provide reasonable prior notice of the leave and make an attempt not to <br />disrupt the operations of the City. This is an unpaid leave; however, employees may use <br />accrued vacation leave. Sick leave may not be used. No more than 16 hours of Parental <br />Leave may be taken during a 12-month period. <br /> <br />Section 4.12 Severe Weather Conditions <br /> <br />As a general policy, City offices will be open for business during regular business hours <br />regardless of inclement weather conditions. Based on individual circumstances, each <br />employee will have to evaluate the weather and road conditions in deciding to report to <br />work and/or leave early. If an employee decides that he or she cannot report to work or <br />remain at work for reasons of personal safety, accommodations will be made to ensure <br />the employee’s pay is not reduced as a result of this absence by allowing the employee <br />to use accrued vacation time or compensation time, by modifying work schedules, or by <br />making any other reasonable adjustments with approval from the respective Department <br />Head. <br /> <br />However, when the following extraordinary circumstances exist, the City Administrator <br />may determine that City Offices should be closed: <br /> <br />• The building is unfit or unsafe for employees to occupy (e.g. a water main <br />break); <br />• Weather conditions make travel impossible (e.g. highways are closed); or <br />• A natural or man-made emergency jeopardizes the health and safety of
