57 <br />the employee gives the City at least 20 days written notice. <br /> <br />All employees eligible to vote at a State general election, at an election to fill a vacancy <br />in the office of United States Senator or Representative, or in a Presidential primary, will <br />be allowed time off with pay to vote on the election day. Employees wanting to take <br />advantage of such leave are required to work with their supervisors to avoid coverage <br />issues. <br /> <br />Section 4.16 Work-related Injury Leave <br /> <br />Worker’s Compensation injury leave generally must be taken concurrently with Family <br />and Medical Leave if the condition meets the Family and Medical Leave and the employee <br />elects Medical Leave of Absence. Employees are allowed, but not required, to apply <br />accrued sick, vacation, holiday and personal leave to any portion of their salary which is <br />not covered by workers’ compensation insurance payments. <br /> <br />Public Employees Retirement Act <br />If an employee on a Work Related Injury leave uses accrued sick, vacation, or <br />holiday leave, the employee’s contributions for PERA will be deducted from the <br />payments from the City and the City will continue to make its contributions. If the <br />employee is not receiving compensation from the City while on a Work-Related <br />Injury Leave, the employee may receive service credits for up to one year by <br />making the City and employee contributions. <br /> <br />If, as part of the Worker’s Compensation process, the employee is offered a <br />medically approved “light duty” position, the employee may decline the position <br />and instead choose to exercise the right to a Medical Leave of Absence if a portion <br />of the 12-week period is available. If the employee accepts the “light duty” position <br />in lieu of taking an available Medical Leave of Absence, the employee is entitled <br />to be replaced in his or her original position or an equivalent position at the time <br />the Medical Leave of Absence would have ended. <br /> <br />Section 4.17 Family and Medical Leave <br /> <br />The Family Medical Leave Act (FMLA) is intended to balance the demands of the <br />workplace with the needs of families, to promote the stability and economic security of <br />families, and to promote national interests in preserving family integrity. It is intended to <br />benefit employees as well as employers by providing up to 12 weeks of unpaid, job <br />protected leave for the birth of a child, adoption, foster care and certain family and medical <br />reasons. <br /> <br />A. Circumstances Covered by Family Leave <br /> <br />Family and Medical Leave include the following types of leave of absences: <br /> A. MEDICAL LEAVE. Leave of absences for personal illness. <br />B. FAMILY CARE LEAVE. Leave of absences for the illness of a family member.
