28 <br />funding availability and subject to the City’s purchasing policy. <br /> <br />Section 3.03 Drug Free Workplace Policy and Federal Omnibus Transportation <br /> <br />A. DRUG FREE WORKPLACE POLICY <br /> <br />The City is committed to the health, well-being and safety of its employees and property. <br />All employees have a responsibility to report to and be at work in a fit condition to perform. <br />The policy has been established for the purpose of providing a safe workplace for all and <br />to comply with the Drug Free Workplace Act. The City’s complete Drug and Alcohol Policy <br />is contained in the Appendix. Violations of the policy may lead to discipline, including <br />discharge. Each situation will be evaluated on a case-by-case basis depending upon the <br />severity and circumstances. <br /> <br />B. FEDERAL OMNIBUS TRANSPORTATION EMPLOYEE TESTING ACT <br /> <br />The purpose of the policy is to establish programs designed to help prevent accidents <br />and injuries resulting from the misuse of alcohol or use of controlled substances by drivers <br />of commercial motor vehicles. The policy implements the requirements of the Federal <br />Omnibus Transportation Employee Testing Act of 1991 and the U.S. Department of <br />Transportation Regulations, 49 C.F.R. Pts. 40, 382. The policy is in addition to and <br />separate from the City’s Drug Free Workplace Act, which implements the requirements <br />of the federal Drug Free Workplace Act of 1988. <br /> <br />The policy is intended only to establish rules necessary under 49 C.F.R. Pts.40, 382. All <br />employees who operate commercial motor vehicles on behalf of the City shall comply <br />with the terms of this policy. The City requires that all employees report to work on time, <br />either scheduled work hours or call-back, in appropriate condition for work. Any employee <br />found to be in violation of this policy is subject to discipline up to and including termination <br />of employment. A copy of the FMSCA Federal Drug-Free Workplace Policy is included <br />in the Appendix. <br /> <br />Section 3.04 Employee Records and Data Privacy <br /> <br />The Human Resources Department maintains personnel records of each employee. A <br />separate file will be kept for any medical information collected regarding each employee. <br /> <br />Data Practices Advisory <br />Employee records are maintained in a location designated by the City Administrator. <br />Personnel data is retained in personnel files, finance files, and benefit/medical files. <br />Information is used to administer employee salary and benefit programs, process payroll, <br />complete state and federal reports, document employee performance, etc. <br /> <br />Employees have the right to know what data is retained, where it is kept, and how it is <br />used. All employee data will be received, retained, and disseminated according to the <br />Minnesota Government Data Practices Act.
