39 <br />Safety Equipment/Gear <br />Where safety equipment is required by federal, state, or local rules and regulations, it is <br />a condition of employment that such equipment be worn by the employee. <br /> <br />Unsafe Behavior <br />Supervisors are authorized to send an employee home immediately when the employee’s <br />behavior violates the City’s personnel policies, Department policies, or creates a potential <br />health or safety issue for the employee or others. <br /> <br />Section 3.13 Serving on Boards or Commissions <br /> <br />Employees will have the opportunity to be considered for openings on City advisory <br />committees and commissions within the following parameters: <br /> <br />Employees may not serve on committees or commissions on which their Supervisor or <br />Department Head is staff liaison. Employees must use the same application form and <br />meet the same criteria as any other citizen. The City Council will consider employees, <br />along with other applicants, at City Council meetings regarding filling the vacancy. The <br />City Administrator will advise the City Council prior to consideration of the employee if a <br />conflict of interest exists. <br /> <br />Section 3.14 Smoke Free Workplace <br /> <br />In accordance with the Minnesota Clean Indoor Air Act and in recognition of the need to <br />provide a smoke-free environment for City employees and visitors, smoking and use of <br />other tobacco products are not allowed in any City-owned building or equipment. <br /> <br />Policy <br />Smoking of any kind, including pipes, cigars, and cigarettes, e-cigarettes, vaping or the <br />use of chewing tobacco, will not be permitted in any Mounds View City building or City <br />owned vehicle. Smoking by City employees is not permitted outside of the front entrance <br />of City Hall. Smoking may only be allowed where it does not endanger life or property or <br />cause discomfort and unreasonable annoyance to other employees. <br /> <br />The Police Department is granted special discretion in regard to this policy when <br />questioning a witness or suspect of a crime. This smoking and tobacco use privilege may <br />only be granted to a member of the public and not to a City employee, including Police <br />Officers, unless they are being questioned. <br /> <br />Violations <br />Employees who violate the smoking and tobacco use policy will be subject to disciplinary <br />action as follows: First Violation - verbal warning; Second Violation - written warning; Third <br />Violation - suspension without pay; Subsequent Continual Violations - may result in <br />termination of employment. <br />
