Item 05C <br />Page 3 of 3 <br /> <br />The Mounds View Vision <br />A Thriving Desirable Community <br /> <br />RESOLUTION NO. 9287 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING APPEAL OF NONCONFORMING DRIVEWAY RELATED <br />TO THE QUINCY STREET RECONSTRUCTION PROJECT FOR <br />5386 QUINCY STREET <br /> <br /> <br />WHEREAS, the City will reconstruct Quincy Street, beginning June 2020; and, <br /> <br />WHEREAS, City Code, Section 1121.09, Subd f(g); g. states; “In conjunction with <br />street improvement projects or in conjunction with individual driveway replacement <br />projects, nonconforming curb cuts shall be made conforming to whatever extent <br />practicable. If, in the opinion of the directors of public works and community development, <br />a nonconforming curb cut cannot be made conforming without undue hardship or <br />disruption to the property, the curb cut may remain in existence, unchanged. Decisions <br />regarding curb cuts may be appealed in writing to the City Council”; and, <br /> <br /> WHEREAS, on May 13, 2020, City Staff mailed a notice to property owners of non- <br />conforming driveways of the City’s intent to reinstall curb cuts, to be conforming to the <br />City Code. On May 22, 2020, the City mailed a notice to these property owners, clarifying <br />that any appeal needed to be submitted to the City no later than Friday, June 5, 2020. <br />Four appeals were received; and, <br /> <br /> WHEREAS, on June 8, 2020, the City Council approved Resolution 9285, <br />approving three appeals, and tabled an appeal for 5386 Quincy Street, pending further <br />investigation by Staff; and, <br /> <br /> NOW, THEREFORE BE IT RESOLVED THAT, the Mounds View City Council <br />approves an appeal from Michael Peterson, 5386 Quincy Street, with the following <br />conditions: <br /> <br />1. The driveway curb cut will be reduced from 29’ to 24’ in width. <br />2. The driveway side yard setback will be preserved at 0’, behind the sidewalk. <br /> <br /> <br />Adopted this 22nd day of June, 2020. <br /> <br /> <br /> _______________________________ <br /> Carol A.
