Item No: _05A
Meeting Date: Apr 15, 2020
Type of Business: Planning Case VR2020-002

City of Mounds View Staff Report
To: Mounds View Planning Commission
From: Jon Sevald, Community Development Director
Item Title/Subject: PUBLIC HEARING; Resolution 1117-20, Approval of a
Variance to reduce the front yard setback for a garage,
located at 3016 Woodale Dr.

Introduction
The applicant proposes to tear down their home and detached garage, and build a new home
with an attached garage, requiring a CUP for an oversized garage, and a Variance to setbacks
for the new garage.

Discussion
Within the R-1 Single-Family Residential district, the minimum front yard building setback is 30’,
with exceptions.1 The existing garage is set back 25’, and is non-conforming. As a non-
conforming building, the garage may be replaced where-is, but cannot be expanded such that it
increases the non-conformity.2 The applicant is requesting to expand the footprint of the garage
in the northwest corner. The area of the proposed garage specific to the variance is about 2’ X
4’ (see attached site plan).
Analysis
Required Existing Proposed
Garage Area 1,800 sf (max) 440 sf 1,117 sf
North Front Yard Setback 30’ 25.2’ 26.5’
East Side Yard Setback 5’ N/A N/A
South Rear Yard Setback 5’ 93’ 71’
West Side Yard Setback 5’ 6.5’ 5.2’
Height 18’ (max)3 ? N/A

There are seven criteria for granting a Variance, and is detailed in the resolution. In summary,
there needs to be unique circumstances applicable to the property, and are not the result of the
applicant. In this case, the unique circumstances include the existing 25’ non-conforming
setback (minimum 30’ required) of the detached garage, built in 1963. The applicant is able to
replace the garage where-is without a variance, but is requesting to expand the footprint 2’
wider.

1 City Code, Section 1104.01, Subd 4(a) (Minimum Setbacks for Accessory Buildings, Driveways and Parking Areas)
2 MN Stat §462.357, Subd 1(e) (Nonconformities).
3 City Code, Section 1104.02, Subd 3(f); The height of any accessory building or structure shall not exceed eighteen
feet (18’) or that of the principal structure, whichever is less.
