Item 08A <br />Page 4 of 9 <br />RESOULTUION 9317 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT <br />FOR OPEN AND OUTDOOR STORAGE AS AN ACCESSORY USE, <br />2832 MOUNDS VIEW BOULEVARD <br />(PLANNING CASE CU2020-004 <br />WHEREAS, the applicant, Mike Horsch (JAM Ventures MN Two LLC), has applied for a <br />Conditional Use Permit for Open and Outdoor Storage as an Accessory Use on property located at 2832 <br />Mounds View Boulevard, legally described as: <br />Lot 1, Block 1, Velmier CVS Addition <br />WHEREAS, the property is zoned B-3 Highway Business; and, <br />WHEREAS, the Mounds View City Code, Section 1114.04, Subd 4, requires a Conditional Use <br />Permit for Open and outdoor storage as an accessory use within the B-3 district. Among other conditions, <br />outside storage abutting a residential district must be screened; and, <br />WHEREAS, the Mounds View City Code, Section 1103.08, Subd 6, related to required <br />screening, requires a green belt planting strip at least 8' in height, or a solid fence not less than 6' in <br />height. The subject property includes a 6' solid wooden fence along the western property line adjacent to <br />residential properties, and a chain link fence along the southern property line adjacent to a storm water <br />infiltration basin. The applicant proposes to enclose unfenced areas with an 8' solid wooden fence; and, <br />WHEREAS, the Mounds View City Code, Section 1125.01, Subd 3(b) includes the Criteria for <br />Granting Conditional Use Permits, stating; In granting a conditional use permit, the City Council shall <br />consider the advice and recommendations of the Planning and Zoning Commission and the effect of the <br />proposed use on the Comprehensive Plan and upon the health, safety and general welfare of occupants of <br />surrounding lands. Among other things, the City Council shall make the following findings where <br />applicable (Findings in Bold italics): <br />1. The use will not create an excessive burden on existing parks, schools, streets and other public <br />facilities and utilities which serve or are proposed to serve the area. <br />Finding: The Open and Outdoor Storage will have no impact to public facilities. <br />2. The use will be sufficiently compatible or separated by distance or screening from adjacent <br />residentially zoned or used land so that existing homes will not be depreciated in value and there <br />will be no deterrence to development of vacant land. <br />Finding: The Open and Outdoor Storage will be adequately screened by an 8' solid <br />wooden fence, except along the southern property line, which is adjacent to a <br />wooded storm water infiltration brain. <br />F he .N ioun(4" <br />�l 7 1wivin, 1),_n<<rr;in <br />
