6.0 CURRENT ASSESSMENT <br />The following section is an assessment of the City's current surface water system. The assessment <br />includes surface water system issues identified by the City, found in the RCWD watershed management <br />plan, or as discussed in a specific LSWMP reference identified in Section 4. <br />Based on the assessment presented in this section, the City will develop effective surface water <br />management goals and policies (Section 7) and, with the coordination of the RCWD, establish the <br />implementation measures (Section 8) necessary to enact the goals and policies and address the surface <br />water management issues. <br />As discussed below, it is the intent of the City to take over responsibility for the permitting of stormwater <br />and wetlands. <br />6.1 OFFICIAL CONTROL ASSESSMENT <br />Codes and ordinances (official controls) are necessary tools to support the implementation of this <br />LSWMP. The intent of assessing the City's existing official controls is to identify the adequacy of these <br />controls in order for the City to take over responsibility for the permitting of stormwater and wetlands. As <br />a basis for this assessment, the City's MS4 permit documents include a summary of ordinances required <br />to meet NPDES requirements. The City Code can be found here: <br />http://www.moundsviewmn.org/government/codes regulations and fees/city code.php <br />As part of taking on the stormwater and wetland permitting role, the City adopts RCWD Rules C — <br />Stormwater Management, D — Erosion and Sediment Control, E — Floodplain Management, and F — <br />Wetland Alteration by reference. The corresponding ordinances in the City Code will be updated to reflect <br />this change. Additional steps for the City to take on permitting responsibilities are listed below: <br />• Work with the RCWD to create a memorandum of understanding (MOU) that the City will take on <br />permitting responsibilities. <br />Adopt a resolution taking on WCA responsibility. <br />• Create a protocol guide for issuing permits. It should lay out various procedures including permit <br />application review and closeout process, hydraulics/hydrology data submittal to the RCWD, and <br />an auditing process. <br />• Create a permit application form (including a fee schedule), a permit form, and a permit review <br />checklist. <br />After adoption of this Local Surface Water Management Plan, the City will need to update all applicable <br />portions of City Code as noted above. Per State statute, the City must amend its official controls <br />accordingly within 180 days of LSWMP adoption. In addition, the City must periodically update codes to <br />remain consistent with City goals, policies, and practices.
