Res 9433 <br />Page 2 of 3 <br />Mar 23, 2021 Scott Mareck, Transportation Planner, Ramsey County <br />May 20, 2021 Nick Tomczik, Administrator, Rice Creek Watershed District (CAPROC) <br />May 26, 2021 Nick Valle, Assistant City Attorney, Kennedy & Graven (Plat Opinion) <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council, hereby <br />Approves the Final Plat of Belden River View, with the following conditions: <br />Approval of this Final Plat is subsequent upon approval for water/sewer supply. The <br />Developer shall obtain sewer/water permits from the City of Fridley (Lots 3, 4, & 5), and <br />comply with requirements stated in Fridley's Public Works Director's letter, dated <br />February 17, 2021. <br />2. The Developer shall comply with all requirements of the Mounds View City Engineer's <br />letter, dated January 21, 2021. <br />3. The Developer shall comply with all requirements of the Rice Creek Watershed District. <br />4. The Developer shall satisfy all requirements made by the City Attorney as stated in the <br />Plat Opinion, or as amended by the City Attorney. <br />5. Upon Final Plat approval, the Developer shall sign a Development Agreement. <br />6. Upon Final Plat approval the Developer shall reimburse the City for review fees by the <br />City Attorney, City Engineer, and any consultants. <br />7. Upon Final Plat approval, the Developer shall pay a Park Dedication Fee of $3,500 per <br />lot, with credit for one lot ($10,500 total). <br />Prior to recording the Plat with Ramsey County, the Developer shall provide an updated <br />and certified Abstract of Title and/or Registered Property Abstract as required by Minn. <br />Stat. § 505.03, or in the alternative, the Developer must provide a Commitment for a Title <br />Insurance Policy for the Property naming the City as the proposed insured and with the <br />amount of coverage for this policy being equal to $100,000.00. <br />9. The Owner of Lot 1 (3032 County Road I) acknowledges that Mounds View City Code <br />generally requires new and existing buildings to be connected to the municipal water <br />system if a municipal water main is constructed adjacent to such property. The Owner <br />acknowledges and agrees that it shall connect to the City's municipal water system if and <br />when a municipal water main adjacent to the Property becomes accessible to the <br />Property. The Owner further acknowledges and agrees that it shall abide by any and all <br />City's requirements related to connections to the municipal water system. <br />10. The Developer shall remove or relocate the shed and pergola on Lot 1 and Lot 3, such <br />that any relocation is compliant with zoning setbacks. <br />11. The Developer shall burry all overhead utilities. <br />
