Item No: 08A <br />Meeting Date: June 14, 2021 <br />Type of Business: Council Business <br />City Administrator Review: <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Jon Sevald, Community Development Director <br />Item Title/Subject: Revocation Hearing: Resolution 9434, Revocation of Rental <br />License #2021-00202 (2075 Hillview Road), and #2021-00203 <br />(2081 Hillview Road) <br />Introduction: <br />Staff is requesting that the City Council conduct a Revocation Hearing to consider the <br />revocation of Rental Licenses issued for two 6-unit apartment buildings, due to numerous <br />violations, dating back to January 2021, that have not been adequately corrected. The property <br />owner has failed to comply with numerous correction orders. It is Staff's opinion that the owner <br />is unable to manage the property, and that it is in the best interest of the tenants and the <br />community that the licenses be revoked. <br />If the City Council revokes the Rental Licenses, the tenants (11 units currently occupied) will <br />need to vacate the properties because an unlicensed rental property cannot be occupied by <br />tenants. A statewide eviction moratorium has been in place since March 23, 20201, and is in <br />effect until the termination of the Governor's Peacetime Emergency related to COVID-19. Staff <br />and the City Attorney will work to determine how to enforce any license revocation should the <br />council take that route. <br />Discussion: <br />2075 Hillview Road, and 2081 Hillview Road are six -unit apartment buildings owned by Thuy Thi <br />Bui since 2002. According to Thu Bui (pronounced Twee Boy), she has had difficulties <br />managing the properties since her partner's death in 2020. <br />The City renewed rental licenses for both properties in November, 2020. Annual licenses are <br />valid January 1st thru December 31st <br />In January, 2021, City inspectors found two persons living in a garage unit at 2075 Hillview <br />Road, and issued orders to vacate the garage. Staff conducted a thorough inspection of both <br />apartment buildings and garages pursuant to code requirements and found numerous <br />violations, and corrective orders were subsequently mailed in January, March, April, and May <br />2021. Numerous re -inspection occurred prior to each subsequent notice. <br />Violations at 2075 Hillview Road, include units #4, #5, #6, Laundry Room, garages, exterior <br />storage, and damage to an exterior wall due to a vehicle collision. An electrical fire occurred in <br />Unit 4 in April, 2021 (unit is presently condemned). <br />Violations at 2081 Hillview Road, include units #3, #4, #6, inoperable laundry appliances, <br />missing smoke alarms, exterior storage behind the garages, inoperable vehicles, cluttered <br />combustible materials in three garage units and unpermitted electrical work. <br />It is staff's opinion that the owner is unable to manage the properties or make necessary repairs <br />as required. The owner has regularly communicated with inspectors, but has failed most re - <br />inspections.
