RESOLUTION NO. 9462 CITY OF MOUNDS VIEW, MINNESOTA A RESOLUTION REQUESTING A VARIANCE FROM STREET DESIGN STANDARD FOR STATE AID OPERATION FOR PROJECT NO. S.A.P. 146-244-001 WHEREAS, the City of Mounds View is preparing plans for MSAH 244 Spring Lake Road beginning at 73rd Ave NE and ending at West County Road J (excluding segment of roadway from Hillview Road to County Road 10); and WHEREAS, Minnesota Rules for State Aid Operation 8820.9936 require minimum design speed of 30 mph; and WHEREAS, the reasons for this variance request are based on one existing horizontal design curve within the right of way which meets a design speed of 20 mph. Challenges prompting this variance request include the existing offset location of the roadway within the Right of Way, existing Right of Way width, proximity of Spring Lake, proposed typical section, and potential needs for Right of Way acquisition. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Mounds View, Ramsey County, Minnesota that the City requests a variance from the Minnesota Department of Transportation State Aid Operations Rules Chapter 8820.9936 (Minimum Design Standards, Urban; New or Reconstruct Projects) to allow a 20 mph minimum design speed in lieu of a 30 mph design speed. BE IT FURTHER RESOLVED, by the City Council of the City of Mounds View, Ramsey County, Minnesota that the City hereby indemnifies, saves and hold harmless the State of Minnesota and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of (project descriptions) in accordance with Minnesota Rules 8820.9936 and further agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim arising as a result of the granting this variance. BE IT FURTHER RESOLVED, by the City Council of the City of Mounds View, Ramsey County, Minnesota that the Mayor and City Administrator are hereby authorized and directed to take all necessary action and to execute all appropriate documents to effectuate the action contemplated by this Resolution. BE IT FINALLY RESOLVED, by the City Council of the City of Mounds View, Ramsey County, Minnesota that the Mayor, City Administrator, City Attorney, staff and consultants are hereby authorized and directed to take any and all additional steps and actions necessary or convenient in order to accomplish the intent of this Resolution.
