MOUNDS VIEW <br />City of Mounds View Staff Report <br />Item No: 4 <br />Meeting Date: September 7 <br />Type of Business: Council Workshop <br />City Administrator Review: <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: Long Lake Woods Development <br />Introduction: <br />Owner's representative Marty Harstad has communicated that the city imposed <br />requirement of obtaining all seven property owners has now been achieved. <br />Council has determined this will be a public project — we will build and own the <br />infrastructure. Thus, development costs include street, storm water, sanitary sewer, <br />and municipal water. <br />There is some question on the storm water infrastructure needed (as stormwater from <br />the south traverses the property) but staff believes that issue will be resolved in the <br />feasibility study. <br />Discussion: <br />The next step in this process is executing the development agreement with Mr. Harstad. <br />There are "blanks" to be filled in and they are specific to assessment and development <br />costs. <br />1. The development will create 12 new lots and result in two non -conforming lots <br />owned by Mr. Holl and Mr. and Mrs. Doll becoming conforming, thus buildable. <br />Kennedy and Graven has opined that those two lots cannot be assessed due to a <br />provision in our city charter. However, they advise that if utility hook up's are built <br />into the project (and staff recommends they are) that a "hook-up" fee equal to the <br />assessment can be imposed and collected at the time connections are made. <br />Thus Doll and Holl incur no cost as part of the development and only incur cost if <br />and when a hook-up is made. <br />2. Condemnation costs cannot be spread across the 12 but not across Doll (but <br />possibly Holl) and are estimated to total between $40,000 and $60,000 with legal <br />fees and property acquisition cost as a function of the appraisal process detailed <br />in statute.
