M0U--N-DitSVV!rW <br />City of Mounds View Staff R1 <br />Item No: 08E <br />Meeting Date: October 25, 2021 <br />Type of Business: Council Business <br />City Administrator Review: <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administration <br />Item Title/Subject: First Reading and Introduction, Ordinance 982 Amending <br />Title III, Administration, Chapter 37, Public Improvements <br />and IX, Chapter 92, Parks and Recreation <br />Introduction: <br />Chapter 37 of the Mounds View Municipal Code, Public Improvements, is outdated <br />where it refers to reapportionment of public improvements and assessing properties, <br />therefore, Staff has proposed changes to this Chapter. <br />Chapter 92 has one minor correction. <br />Discussion: <br />Currently the City Code, in Chapter 37, contains specific calculations to reapportion <br />public improvement assessments. As the City does not currently follow this method for <br />assessing properties, Staff is proposing to revise the Code to state that any proposed <br />assessments shall be determined on a project -by -project basis by the City Council. <br />In addition, the proposed ordinance provides the City Council with flexibility when levying <br />special assessments for public improvement projects by removing the rigid dollar amounts <br />and percentages that were previously used to calculate assessments and replacing those <br />with maximum percentages, subject to statutory limitations. <br />Chapter 92 contains an excerpt where it refers to the City's fees schedule for violations <br />of that Chapter. However, because violations of the Chapter are misdemeanors and <br />are handled via the Ramsey Court system, their fees and penalties would apply. <br />Therefore, this excerpt should be removed from the Mounds View Fee Schedule. <br />Staff Recommendation: Staff recommends that the City Council conduct the First <br />Reading and Introduction of Ordinance 982.
