At no time shall any animal be left unsupervised while outdoors; <br />(4) Outdoor exercise shall be conducted so as not to unreasonably annoy, injure or <br />endanger the health, safety, comfort or welfare of the public; <br />(5) All animal boarding facilities shall comply with the nuisance codes established for the <br />city, and <br />(6) All animal boarding facilities shall comply with the state's Pet and Companion Animal <br />Welfare Act (M. S. §§ 346.35 through 346.44, as they may be amended from time to <br />time). 2 <br />The outdoor area (L-shaped) between the building and garage is about 15' in depth, and about <br />10' in depth behind the garage. This area will be fenced (6' chain -link, with tarp/canvas). There <br />is an apartment building to the west, which would be most affected. Dogs will be supervised at <br />all times, when outdoors. <br />There are eleven parking stalls in front of the building. Parking requirements for animal <br />boarding and the furniture store, are based on factors unknown at this time. The building owner <br />and tenants do not have a final plan as to how the building will be divided for each use, which <br />would be used to calculate parking requirements. In Staff's opinion, parking should be <br />adequate for these two tenants, although it will not comply with the City Code (estimate <br />requiring 16 stalls for Animal Boarding, and 47 for Furniture Store). 3 <br />Strategic Plan Strategy/Goal: <br />Continue BR&E program, maximize utilization of development space and current list of available <br />sites, encourage land owners to maintain their properties, & consider residential redevelopment. <br />Financial Impact: <br />N/A <br />Planning Commission Recommendation: <br />The Planning Commission recommends approval (Resolution 1140-21). The Commission's <br />discussion included waste removal (waste bin outside), urine odor if keeping lawn (vs. <br />concrete), building ventilation (will be addressed as part of the building permit), potential of dogs <br />escaping when transitioning between owners' vehicles and the building entrance. <br />Staff Recommendation: <br />Staff recommends approval.
