Item 08A
Page 2of6
(3) All animal boarding activities shall be conducted indoors, except for necessary outdoor
exercise. At no time shall any animal be left unsupervised while outdoors;
(4) Outdoor exercise shall be conducted so as not to unreasonably annoy, injure or
endanger the health, safety, comfort or welfare of the public;
(5) All animal boarding facilities shall comply with the nuisance codes established for the
city, and
(6) All animal boarding facilities shall comply with the state's Pet and Companion Animal
Welfare Act (M. S. §§ 346.35 through 346.44, as they may be amended from time to
time). 2
The outdoor area (L-shaped) between the building and garage is about 15' in depth, and about
10' in depth behind the garage. This area will be fenced (6' chain -link, with tarp/canvas). There
is an apartment building to the west, which would be most affected. Dogs will be supervised at
all times, when outdoors.
There are eleven parking stalls in front of the building. Parking requirements for animal
boarding and the furniture store, are based on factors unknown at this time. The building owner
and tenants do not have a final plan as to how the building will be divided for each use, which
would be used to calculate parking requirements. In Staff's opinion, parking should be
adequate for these two tenants, although it will not comply with the City Code (estimate
requiring 16 stalls for Animal Boarding, and 47 for Furniture Store). 3
Strategic Plan Strategy/Goal:
Continue BR&E program, maximize utilization of development space and current list of available
sites, encourage land owners to maintain their properties, & consider residential redevelopment.
Financial Impact:
N/A
Planning Commission Recommendation:
The Planning Commission recommends approval (Resolution 1140-21). The Commission's
discussion included waste removal (waste bin outside), urine odor if keeping lawn (vs.
concrete), building ventilation (will be addressed as part of the building permit), potential of dogs
escaping when transitioning between owners' vehicles and the building entrance.
Staff Recommendation:
Staff recommends approval. Based on the Planning Commission's review, conditions have
been added requiring a solid fence, and trees in-between the kennel and adjacent apartments.
MN Statute §346.39 (Dogs and Cats) provides the care standards for the keeping of dogs and cats.
Mounds View City Code §160.342 Schedule of Off -Street Parking requirements)
Office building, animal hospital and professional office, Three spaces, plus one space for each 175 square feet
of floor area.
