Item No: 08E <br />Meeting Date: Dec 13, 2021 <br />MOLNDSST <br />VIEW Type of Business Council Business <br />City Administrator Review: <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Jon Sevald, Community Development Director <br />Item Title/Subject: Resolution 9495 Denying a Conditional Use Permit for an <br />Animal Boarding Facility; 5491 Adams Street <br />Introduction: <br />Paul Holt is proposing to operate a dog training and boarding facility at the former Fedor's <br />Market. <br />The City Council conducted a Public Hearing on November 22, 2021 to consider; (1) a <br />Commercial Kennel License; and (2) a Conditional Use Permit (CUP) for an Animal Boarding <br />Facility. The Council denied the Kennel License (Resolution 9492), and Tabled action on the <br />CUP, to allow Staff time to prepare a Resolution for Denial. <br />The Resolution for Denial is based on; (1) the location of the outdoor kennel is not appropriate <br />because of the short distance (20') to a residential property, and to a residence (25); (2) the <br />outdoor kennel does not include a cleanable surface (e.g. grass is proposed vs. an impervious <br />washable surface); and (3) the applicant has provided insufficient information regarding the <br />interior of the building (e.g. how the indoor kennel will comply with City Code regulations). <br />Discussion: <br />Fedor's Market operated between 1961 and 2016. The property was sold in July, 2021. The <br />owner; Andrei Bortnov (BBAK Ventures, LLC) is renovating the building for two tenants; a <br />kennel boarding/training business (Paul Holt); and a furniture store. <br />The applicant will use about 1,300 sq ft of the 6,000 sq ft building. There is planned to be up to <br />ten dogs boarded at one time, although the CUP (if approved) does not limit the number of <br />dogs. An outdoor kennel would be located between the building and detached garage, and <br />behind the detached garage, for use by the dogs to relieve themselves, and exercise.' <br />During the November 22nd Public Hearing, four people spoke (three in opposition). Public <br />Comments (summarized) included: <br />• Outdoor kennel area is too small. <br />• Questions regarding confinement areas (indoor & outdoor), size and surfaces. <br />• Dogs if kept outdoors, will bark at people walking thru the property to The Station, and <br />bark at the carwash when in use. <br />• Question of how long dogs will be unattended. <br />Staff Response: <br />Within the B-2 district, there is no minimum setback for outdoor kennels.
